David Dudley FIELD (1805-1894) admitted to the New York bar in 1828 and achieved renown in arguments before the Supreme Court. His greatest achievements were in the sphere of law reform. He was a consist supporter of codification, being made a member of a New York codifying commission in 1846. Between 1860 and 1865 complete political, civil, and penal codes were prepared, but only the Penal Code was adopted in 1881. After a great struggle the Civil Code was finally rejected in New York. But his Code of civil procedure has been adopted by many states. California adopted all five Field codes. He urged the preparation of a code of international law. His brother, Stephen Johnson Field (1816-1899) removed to California where he drafted codes of civil and criminal procedure, served as Chief Justice of the Supreme Court of California (1859-63) and an Associate Justice of the U.S. Supreme Court (1863-97). Introduction The Civil Code mentioned in the preceding report, is contained in thios volume. Its history is as follows: The Constitution of the State of New York, as revised and adopted in 1846, has two provisions looking to a codification of the laws. One is in the 17th section of the first article, in these words: "The Legislature at its first session after the adaption if this Constitution, shall appoint three Commissioners whose duty it shall be to reduce into a written and systematic Code, the whole body of the law of this Statem or so much and such parts thereof as to the said Commissioners shall seem practicable and expedient." Whether a general Code of the law be pissible, should seem, from the nature of the subject, hardly to be doubtful. The common law of New York, like the common law of England, from which it is in great part derived, . It was fully proven by what had been done in respect to the law of other countries. The law of Rome in the time of JUSTINIAN was, to say the least, as difficult of reduction into a Code as is our own law at the present day. Yet it was thus reduced, though, no doubt, to the disgust and dismay of many a lawyer of that period. The concurring judgment of thirteen century since, has, however, pronounced the Code of JUSTINIAN one of the noblest benefactions to the human race, as it was one of the greatest achievments of human genius. France, at the beginning of her revolution, was governedpartly by Roman and partly by customary law. The French Codes made one uniform system for the whole country, supplanting the former laws, and forming a model by which half of Europe has since fashioned its legislation.
