A BILL ΤΟ Amend the Sale of Food and Drugs Act, 1875, by A.D. 1926. regulating the liability of milk producers in respect of milk adulteration. E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows: Vict. c. 63. 1. Notwithstanding anything contained in the Sale Amendment of Food and Drugs Act, 1875, as amended by any later of 38 & 39 Act, no proceedings shall be taken under that Act against any person being a consignor of milk based on a 10 sample or samples of milk taken after the milk has been accepted by a railway company for conveyance to the consignee whatever the place of delivery under the contract between the consignor and the consignee may be. 15 2. The medical officer of health or any other officer Power of who under the Sale of Food and Drugs Acts is authorised medical to procure samples of milk in course of delivery to the officer to purchaser or consignee in pursuance of any contract for procure samples of the sale to such purchaser or consignee of such milk, may milk during 20 procure any sample of such milk at any time during the transit. transit thereof from the producer's farm to the railway station from which it is to be sent to the place of delivery, or at the time of the delivery thereof to the railway company's servants at such railway station. The medical officer of health or any other officer authorised for the purpose by a local authority within the area of which, in pursuance of any such contract as is mentioned in the last preceding section hereof, milk is to be delivered, may by notice in writing require the 5 medical officer of health or other authorised officer of any other local authority, being an authority for the purposes of the Sale of Food and Drugs Acts, to take samples of the milk in the course of transit as provided in the said last preceding section hereof. 10 4. Upon receipt of such notice it shall be the duty of the medical officer of health or other authorised officer of the other authority, as soon as practicable, to take samples in the manner directed by the Sale of Food and Drugs Acts as to the division thereof into parts and to 15 forward to the officer who gave the notice a part of any sample so taken. 5. Any person who conveys or delivers or causes to be conveyed or delivered to a railway station for transit by rail any such milk as aforesaid from which milk fat 20 has been abstracted or to which water has been added shall be guilty of an offence under the Sale of Food and Drugs Acts. 6. This Act shall not apply to skimmed milk. 7. This Act may be cited as the Sale of Food and 25 Drugs Act, 1926, and the Sale of Food and Drugs Acts, 1875 to 1899, and this Act may be cited collectively as the Sale of Food and Drugs Acts, 1875 to 1926, and are in this Act referred to as the Sale of Food and Drugs Acts. 30 |
