A BILL ΤΟ Amend the provisions of the Prisons (Scotland) A.D. 1926. Act, 1877, relating to the discontinuance of prisons, and the legalisation of police cells as places of detention. E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows: 1. Where, after the passing of this Act, any prison Disposal of shall be discontinued by an order made by the Secretary discontinued for Scotland under section thirty-nine of the Prisons prison. (Scotland) Act, 1877, the provisions of section forty of 10 the said Act shall not apply, and any prison so discontinued shall be sold or otherwise disposed of as the Secretary for Scotland, with the consent of the Treasury, may direct. 2.-(1) Section thirty of the Prisons (Scotland) Act, Amendment 15 1877 (which relates to the legalising of police cells as of 40 & 41 places of detention), shall be amended by the substitution Vict. c. 53. of the words "thirty days" for the words "fourteen s. 30. days.' (2) For the purposes of the said section, the county 20 council of Orkney and the county council of Zetland shall be deemed to be the police authorities of the said counties respectively (inclusive of any burghs situate therein except the burgh of Lerwick): Provided always Scotland to make such arrangements as may be necesA.D. 1926. that it shall be the duty of the Prison Commissioners for sary for the removal of any prisoners confined in police cells in either of the said counties legalised under the said section. Citation. 3. This Act may be cited as the Prisons (Scotland) Act, 1926, and this Act and the Prisons (Scotland) Acts, 1860 to 1909, may be cited as the Prisons (Scotland) Acts, 1860 to 1926. 5 Prisons (Scotland). This Bill is designed to protect those animals which though nominally wild are, in fact, kept in captivity or confinement and released for the purpose of being hunted or coursed. This Bill does not apply to any form of sport which is concerned with wild animals in their natural condition of freedom, and does not in any way interfere with the hunting or coursing of such animals. The word "animal" in this Act means any Definition quadruped." 2. Any person who promotes, arranges, conducts, Penalties. assists or takes part in the hunting or coursing of any 10 animal which is or has to his knowledge been kept in captivity or confinement, shall be liable upon summary conviction to a fine not exceeding twenty-five pounds, or, alternatively, or in addition thereto, to be imprisoned, with or without hard labour, for a term not exceeding 15 three months. 3. This Act shall not apply to the hunting or cours- Application ing of any animal which has been kept in confinement of Act. if it be proved that such animal has been released from such confinement at least eight days before the day 20 on which such hunting or coursing takes place unless the said animal has been released in a maimed, injured, |
