Amend the Protection of Animals Act, 1911.

E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows:

A.D. 1926.

1. Subsection (3) paragraph (b) of section one of Amendment the Protection of Animals Act, 1911, shall be amended of Protecby repealing the words after the word "condition" to tion of the end of paragraph (b) and by the insertion in the Act, 1911. 10 place thereof of the following words :

4. This Act shall be cited as the Protection of Short title. Animals (1911) Amendment Act, 1926.

1. (1) The provisions of the Public Health Act, 1875, relating to smoke nuisances shall be amended as follows:

nuisances.

(a) For the purposes of section ninety-one of the Vict. c. 76
Act a chimney (not being the chimney of a in respect of
private dwelling-house) sending forth smoke smoke
in such quantity as to be a nuisance shall be
deemed to be a nuisance liable to be dealt with
summarily in manner provided by that Act,
notwithstanding that the smoke is not black
smoke :

(b) For the purposes of sections ninety-one, ninety-
two, and one hundred and two of the Act the
expression "smoke" shall include soot, ash, grit,
and gritty particles :

(c) Where the complaint upon which a summons is
issued relates to a smoke nuisance, fifty pounds
shall be substituted for five pounds as the
maximum penalty which may be imposed under
section ninety-six of the Act:
