of this Act, shall be commenced within 6 calendar months after the fact committed, and not afterwards, except where the cause of action shall have arisen in any place not within the jurisdiction of any of Her Majesty's Courts having civil jurisdiction, and then within 6 calendar months after the plaintiff and defendant shall have been both within the jurisdiction of any such Court; and every such action or suit shall be brought in the place where the cause of action shall have arisen, and not elsewhere, except where the cause of action shall have arisen in any place not within the jurisdiction of any of Her Majesty's Courts having civil jurisdiction; and the defendant shall be entitled to the like notice, and shall have the like privilege of tendering amends to the plaintiff, or his agent or attorney, as is provided in actions brought against any justice of the peace for any act done by him in the execution of his office. VII. And be it enacted, that this Act may be amended or repealed by any Act to be passed in this session of Parliament. NOTICE of the British Treasury, relative to the Distribution of the Compensation for Opium, under the Treaty of Peace with China. 25th August, 1843. WHEREAS by a certain Treaty, signed at Nanking on the 29th day of August, 1842, by the Plenipotentiaries of Her Majesty and of the Emperor of China, it was, among other things, agreed, that the Emperor of China should pay the sum 6,000,000 of dollars, as the value of the British-owned opium delivered up at Canton in the month of March, 1839: And whereas, to enable Her Majesty to afford compensation to the parties who surrendered the said British-owned opium, Parliament has granted the sum of £1,281,211, being the produce in sterling of the said 6,000,000 of dollars, after deducting the sum of £33,977, on account of 500 chests of opium, provided at the expense of Her Majesty's Government: And whereas Her Majesty has authorised the Lords Commissioners of Her Treasury to distribute the said sum of £1,281,211 amongst the said parties entitled to compensation, according to the ascertained relative value of the several descrip tions of opium delivered up; which appears to be, for each chest of Patna, 661. 78. 74d.; Benares, 617. 11s. 34d.; Malwa, 64l. 11s. 2d.; Turkey, 431. 3s. 5d. Notice is hereby given by the Lords Commissioners of Her Majesty's Treasury, that the holders of the accountable receipts or certificates given by Captain Charles Elliot, R.N., late Her Majesty's chief superintendent of trade in China, for the said British-owned opium, entitled to compensation, may, on or after Wednesday, the 30th day of August, 1843, apply at the office of the Paymaster of Civil Services, at the Treasury-chambers, Whitehall, London, for payment. But they are required, 2 whole days, at least, before making such application, to leave at, or transmit to, the said Treasurychambers, addressed to Charles Edward Trevelyan, Esquire, Assistant-Secretary, the said receipts or certificates, for which they will receive in exchange an acknowledgment. As the receipts or certificates were made in quadruplicate, the parties applying will be required to hand all the 4 parts over, or to give a satisfactory account of such parts as are not in their hands. VICTORIA R., VICTORIA, by the grace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith: to all to whom these presents shall come, greeting: Whereas, by a certain Act of Parliament passed in the 7th year of Our reign, intituled "An Act for the better government of Her Majesty's subjects resorting to China," it is among other things enacted, that it shall be lawful for Us, by any Commis sion or Commissions under the Great Seal of the United Kingdom, or by any Instructions under Our Signet and Sign Manual accompanying and referred to in any such Commission or Commissions, to authorize the Superintendent of Our subjects in China (so long as such Superintendent shall be also the Governor of the Island of Hong Kong), to enact, with the advice of the Legislative Council of the said Island of Hong-Kong, all such laws and ordinances as may from time to time be required for the peace, order, and good government of Our subjects being within the dominions of the Emperor of China, or being within any ship or vessel at a distance of not more than 100 miles from the coast of China, and to enforce the execution of such laws and ordinances by such penalties and forfeitures as to him, with the advice aforesaid, shall seem fit; and that it shall also be lawful for Us, by any such Commission or Commissions, or Instructions as aforesaid, to impose upon the exercise of the before-mentioned legislative authority all such conditions and limitations as We shall see fit to prescribe: Now know ye, that of Our mere motion, special grace, and certain knowledge, We, in pursuance and exercise of the power and authority so vested in Us as aforesaid by the said recited Act, have granted and authorized, and do hereby grant and authorize the said Superintendent of the Trade of Our subjects in China, (so long as such Superintendent shall be also the Governor of the said Island of Hong Kong), to enact, with the advice of the Legislative Council of the said Island of Hong Kong, all such laws and ordinances as may from time to time be required for the peace, order, and good government of Our subjects being within the dominions of the Emperor of China, or being within any ship or vessel at a distance of not more than 100 miles from the coast of China, and to enforce the execution of such laws and ordinances by such penalties and forfeitures as to such Superintendent as aforesaid, by the advice aforesaid, shall seem fit; and We do hereby, in further exercise of the powers and authority aforesaid, impose upon the exercise of the before-mentioned legislative authority, all such conditions and limitations as We have seen fit to prescribe in the Instructions under Our Signet and Sign Manual accompanying this Our Commission.
