In accordance with the provisions of the Constitution of the State of Tennessee, the Thirty-ninth General Assembly convened at the Capitol, at Nashville, on Monday, the 4th day of January, 1875.

The Senate was called to order by Clay Roberts, the former Assistant Clerk, at 12 o'clock м.

On motion of Mr. Wade, Mr. Polk was called to preside temporarily over the Senate; but Mr. Polk not being present, on motion of Mr. Overton, Mr. Wade was called to the chair.

The Clerk proceeded to call the roll by Districts, whereupon the following Senators appeared and were severally sworn in by his Honor, Judge Nathaniel Baxter:

I. DISTRICT-Composed of the counties of Johnson, Carter, Washington, and Greene, W. C. EMMERT.

II. DISTRICT-Composed of the counties of Sullivan, Hawkins, Hamblen, Hancock, and Claiborne, J. C. HODGES.

III. DISTRICT-Composed of the counties of Cocke, Jefferson, Sevier, and Blount, J. C. ELLIS.

IV. DISTRICT—Composed of the counties of Union, Grainger, Anderson, and Knox, W. H. TURLEY.

V. DISTRICT-Composed of the counties of Campbell, Morgan, Scott, Roane, Fentress, Overton, White, Putnam, and Cumberland, COLUMBUS MARCHBANKS.

VI. DISTRICT-Composed of the counties of Loudon, Monroe, McMinn, Meigs, Bradley, and Polk, A. BLIZARD.

VII. DISTRICT-Composed of the counties of Rhea, James, Hamilton, Bledsoe, Sequatchie, Van Buren, Marion, and Grundy, L. S. MARYE.

VIII. DISTRICT-Composed of the counties of Warren, Coffee, DeKalb, and Cannon, JAMES A. JONES.

IX. DISTRICT-Composed of the counties of Macon, Smith, Clay, Trousdale, Sumner, and Jackson, THOMAS H. BUTLER.

X. DISTRICT-Composed of the counties of Rutherford and Bedford, THOMAS G. MOSELEY.

XI. DISTRICT-Composed of the county of Davidson, JOSEPH D. WADE.

XII. DISTRICT-Composed of the counties of Davidson and Wilson, HENRY R. BUCHANAN.

XXI. DISTRICT-Composed of the counties of Madison and Hardeman, HORACE M. POLK.

XXIII. DISTRICT-Composed of the counties of Shelby, Fayette, and Tipton, PEYTON J. SMITH.

XXIV. DISTRICT-Composed of the county of Shelby, JOHN OVERTON, JR.

XXV. DISTRICT-Composed of the county of Shelby, A. B. HAYNES.

ELECTION OF SPEAKER.

There being a quorum present, the Chairman announced that the first business in order was the election of a Speaker, and that nominations were in order.

On motion of Mr. Overton, the Senate proceeded to ballotting directly for Speaker without any formal nominations, and the first ballot was had with the following result:

Senators voting for Mr. Paine are:

Messrs. Aden, Blizard, Boyd, Buchanan, Jordan, Ragland, and Trotter.

Senators voting for Mr. Blizard are:

Messrs. Butler, Ellis, Emmert, Marchbanks, Paine, Quarles, and

Turley.

Senators voting for Mr. Moseley are:
Messrs. Haynes and Hodges.

Senators voting for Mr. Haynes are:

Messrs. Overton, Smith, Wade, and Wilson.

There being no election, the Senate proceeded to the second ballot, with the following result:
