APPENDIX E.

MEMORANDUM FROM THE MINISTRY OF HEALTH.

I am directed by the Minister of Health to draw attention to Section 2 (2) of the Old Age Pensions Act, 1908, as amended by Section 3 (1) of the Old Age Pensions Act, 1911, and by subsections (1) and (2) of Section 2 of the Old Age Pensions Act, 1919. It will be seen that it is a statutory condition for the receipt of an old age pension that the claimant must satisfy the pension authorities that for at least 10 years up to the date of the receipt of any sum on account of a pension he has been a British subject. This condition is, however, not required to be fulfilled in the case of a woman who satisfies the pension authorities that she would, but for her marriage with an alien, have fulfilled the condition.

The Pension Officer who reports on the claim for an old age pension considers the question of nationality, and it rests with the claimant before he can obtain a pension to satisfy the local Peusion Committee, or, on appeal the Minister of Health that he fulfils the statutory conditions.

So far as this Department is aware the existing arrangments for excluding persons not entitled to pensions are sufficient but the Customs and Excise Department would be in a better position to furnish you with information on that question.
