STANDING COMMITTEE A, to whom the HOME COUNTIES (MUSIC AND DANCING) LICENSING BILL was referred;-Have gone through the Bill and made Amendments thereunto. HOME COUNTIES (MUSIC AND DANCING) Clause 1, agreed to. Clause 2. Amendment proposed, in page 1, line 12, to leave out all the words from the word "expressions" to the word "in" in line 14, in order to insert the words "licensing area' shall mean (a) the county borough; or (b) the borough or urban district having a population according to the last census for the time being of not less than twenty thousand; or (c) the county (except so much thereof as may be comprised within any such borough or urban district)"-(Mr. Looker),—instead thereof. Question proposed, "That the words 'county' and 'county borough' stand part of the Clause." Amendment, by leave, withdrawn. Amendments made, in page 1, line 13, by leaving out the words "shall mean,' and inserting the words "mean respectively "(Mr. Ernest Alexander),-instead thereof; and in page 1, line 16, by leaving out the words "mean respectively," and inserting the word "means "—(Mr. Ernest Alexander),-instead thereof. Clause, as amended, agreed to. Clause 3. Amendments made, in page 1, line 21, by leaving out the words "or ordinarily used"; and in page 2, line 24, by leaving out the words "whether by way of renewal or otherwise ”—(Mr. Ernest Alexander). Another Amendment proposed, in page 2, line 35, after the word "police," to insert the words "of the police division"-(Mr. Looker).-Question proposed, "That those words be there inserted." Amendment, by leave, withdrawn. Another Amendment made, in page 2, line 36, by leaving out the word "county"-(Mr. Ernest Alexander). Another Amendment made, in page 3, line 18, by leaving out sub-section (7), and inserting the words : 66 (7) If any place is kept for entertainment purposes without a licence, the person so keeping the place and, unless he proves to the satisfaction of the court that the place is so kept without his consent or connivance, any person occupying or rated as occupier of the place shall be liable on summary conviction. to a penalty not exceeding five pounds for every day on which the place is so kept”—(Mr. Ernest Alexander), instead thereof. Another Amendment made, in page 4, line 16, at the end, by adding the words : "(12) Any constable authorised in that behalf by a warrant granted by a justice of the peace may enter any place in respect of which he has reason to suspect that an offence under this Act has been committed. (13) Section eight of The Disorderly Houses Act, 1751 (which provides that any persons appearing as masters of, or having the care of, certain places are to be deemed to be the keepers thereof), shall apply, for the purposes of proceedings under this Act, as it applies for the purposes of proceedings under that Act. (14) Any sums received on account of fees under this section shall be carried to the credit of the county fund or borough fund, as the case may be "-(Mr. Ernest Alexander). Clause, as amended, agreed to. Clause 4. An Amendment made, in page 4, line 19, at the end, by adding the words : "(2) A council being the council of a county may also delegate all or any of its powers under this Act, other than the power to make regulations, to the council of an urban district having a population according to the last census for the time being of not less than twenty thousand, so far as relates to places within that district "-(Captain Hacking). Clause, as amended, agreed to. Clause 5. An Amendment made, in page 4, line 23, at the end, by adding the words: -- "or shall apply to any entertainment provided by a local authority in a park, garden or other place in the control of the local authority, or in any building thereon"-(Captain Hacking).
