paid, it shall be covered into the Treasury; and the Secretary of Agriculture is hereby charged with the proper administration of this law.

5. That the Secretary of Agriculture shall make an annual report to Congress on the receipts and expenditures and work of the agricultural experiment stations in all of the states and territories, and also whether the appropriation of any state or territory has been withheld; and if so, the reason therefor.

6. That congress may at any time amend, suspend, or peal any or all of the provisions of this act. APPROVED, March 16, 1906.

CLAUSE INTERPRETING ADAMS ACT

The act of Congress approved March sixteenth, nineteen hundred and six, entitled "An act to provide for an increased annual appropriation for agricultural experiment stations and regulating the expenditures thereof," shall be construed to appropriate for each station the sum of five thousand dollars for the fiscal year ending June thirtieth, nineteen hundred and six, the sum of seven thousand dollars for the fiscal year ending June thirtieth, nineteen hundred and seven, the sum of nine thousand dollars for the fiscal year ending June thirtieth, nineteen hundred and eight, the sum of eleven thousand dollars for the fiscal year ending June thirtieth, nineteen hundred and nine, the sum of thirteen thousand dollars for the fiscal year ending June thirtieth nineteen hundred and ten, and the sum of fifteen thousand dollars for the fiscal year ending June thirtieth, nineteen hundred and eleven. The sum of five thousand dollars appropriated for the fiscal year nineteen hundred and six shall be paid on or before June thirtieth, nineteen hundred and six, and the amounts appropriated for the subsequent years shall be paid as provided in the said act to each state and territory for the more complete endowment and maintenance of agricultural experiment stations now established or which may hereafter be established in accordance with the act of Congress approved March second, eighteen hundred and eighty-seven. AGRICULTURAL

* That there shall be, and hereby is, annually appropriated, out of any money in the Treasury not otherwise appro priated, to be paid as hereinafter provided, to each state and territory for the more complete endowment and maintenance of agricultural colleges now established, or which may hereafter be established, in accordance with the act of Congress approved July second, eighteen hundred and sixty-two, and the act of Congress approved August thirtieth, eighteen hundred and ninety, the sum of five thousand dollars, in addition to the sums named in the said act, for the fiscal year ending June thirtieth, nineteen hundred and eight, and an annual increase of the amount of such appropriation thereafter for four years by an additional sum of five thousand dollars over the preceding year, and the annual sum to be paid thereafter to each state and territory shall be fifty thousand dollars, to be applied only for the purposes of the agricultural colleges as defined and limited in the act of Congress approved July second, eighteen hundred and sixty-two, and the act of Congress approved August thirtieth, eighteen hundred and ninety.

That the sum hereby appropriated to the states and territories for the further endowment and support of the colleges shall be paid by, to, and in the manner prescribed by the act of Congress approved August thirteenth, eighteen hundred and ninety, entitled "An act to apply a portion of the proceeds of the public lands to the more complete endowment and support of the colleges for the benefit of agriculture and the mechanic arts established under the provisions of the act of Congres approved July second, eighteen hundred and sixty-two," and the expenditure of the said money shall be governed in all respects by the provisions of the said act of Congress approved July second, eighteen hundred and sixty-two, and the said act of Congress approved August thirtieth, eighteen hundred and ninety: Provided, That said colleges may use a portion of this money for providing courses for the special preparation of instructors for teaching the elements of agriculture and the mechanic arts. DETAIL OF OFFICERS OF THE ARMY

[Extract from the act of Congress approved May 4, 1880.]

That upon the application of any college, university, or institution of learning incorporated under the laws of any state within the United States, having capacity at the same time to educate not less than one hundred and fifty male students, the President may detail an officer of the army on the retired list to act as president, superintendent, or professor thereof; and such officer may receive from the institution to which he may be detailed the difference between his retired and full pay, and shall not receive any additional pay or allowance from the United States.

REVISED STATUTES OF THE UNITED STATES

1225. The President may, upon the application of any established military institute, seminary or academy, college or university, within the United States having capacity to educate at the same time not less than one hundred and fifty male students, detail an officer of the army or navy to act as superintendent, or professor thereof; but the number of officers so detailed shall not exceed fifty from the army, and ten from the navy, being a maximum of sixty, at any time, and they shall be apportioned throughout the United States, first, to those state institutions applying for such detail that are required to provide instruction in military tactics under the provisions of the act of congress of July second, eighteen hundred and sixty-two donating lands for the establishment of colleges where the leading object shall be the practical instruction of the industrial classes in agriculture and the mechanic arts, including military tactics; and after that said details to be distributed, as nearly as may be practicable, according to population. The Secretary of War is authorized to issue, at his discretion and under proper regulations to be prescribed by him, out of ordnance and ordnance stores belonging to the government, and which can be spared for that purpose, such number of the same as may appear to be required for military instruction and practice by the students of any college or university under the provisions of this section, and the Secretary shall require a bond in each case, in

double the value of the property, for the care and safe keeping thereof, and for the return of the same when required: Provided That nothing in this act shall be so construed as to prevent the detail of officers of the engineer corps of the navy as professors in scientific schools or colleges as now provided by act of congress approved February twenty-sixth, eighteen hundred and seventy-nine, entitled, "An act to promote a knowledge of steam-engineering and iron-ship building among the students of scientific schools or colleges in the United States;" and the Secretary of War is hereby authorized to issue ordnance and ordnance stores belonging to the government on the terms and conditions herein before provided to any college or university at which a retired officer of the army may be assigned as provided by section twelve hundred and sixty of the Revised Statutes. AN ACT to amend section twelve hundred and twenty-five of the Revised Statutes, concerning details of officers of the army and navy to educational institutions.

Be it enacted by the Senate and House of Representatives of the United States of America, in Congress assembled, That section twelve hundred and twenty-five of the Revised Statutes, concerning details of officers of the army and navy to educational institutions, be, and the same is hereby, amended so as to permit the President to detail, under the provisions of said act, not to exceed seventy-five officers of the army of the United States; and the maximum number of officers of the army and navy to be detailed at any one time under the provisions of the act passed September twenty-sixth, eighteen hundred and eightyeight, amending said section twelve hundred and twenty-five of the Revised Statutes, is hereby increased to eighty-five: Provided that no officer shall be detailed to or maintained at any of the educational institutions mentioned in said act where instruction and drill in military tactics is not given: Provided further, That nothing in this act shall be so construed as to prevent the detail of officers of the engineer corps of the navy as professors in scientific schools or colleges as now provided by act of congress approved February twenty-sixth, eighteen hundred and seventy-nine, entitled "An act to promote a knowledge of steam

engineering and iron-ship building among the students of scientific schools or colleges in the United States."

AN ACT to increase the number of officers of the army to be detailed to colleges.

Be it enacted by the Senate and House of Representatives of the United States of America, in Congress assembled, That section twelve hundred and twenty-five of the Revised Statutes, concerning details of officers of the Army and Navy to educational institutions, be, and the same is hereby, amended so as to permit the President to detail under the provisions of said act not to exceed one hundred officers of the Army of the United States; and no officer shall be thus detailed who has not had five years service in the Army and no detail to such duty shall extend for more than four years and officers on the retired list of the Army may upon their own application be detailed to such duty and when so detailed shall receive the full pay* of their rank; and the maximum number of officers of the Army and Navy to be detailed at any one time under the provisions of the act approved January thirteenth, eighteen hundred and ninety-two, amending section twelve hundred and twenty-five of the Revised Statutes as amended by an act approved September twenty-sixth, eighteen hundred and eighty-eight, is hereby increased to one hundred and ten.

Provided, That nothing in the Act entitled "An Act to increase the number of officers of the Army to be detailed to colleges,"

*By act of Congress, approved March 2, 1905, it was provided:

"That retired officers of the Army above the grade of major, heretofore or hereafter assigned to active duty, shall hereafter receive their full retired pay and shall receive no further pay or allowances from the United States: Provided further, That a colonel or lieutenant colonel so assigned shall receive the full pay and allowances of a major on the active list."

By a decision of the Assistant Comptroller of the Treasury, published May 18, 1905, a colonel or lieutenant colonel on the retired list assigned to duty at an educational institution, under act of November 3, 1893, is considered on active duty, and under the provisions of the act of March 2, 1905, is entitled to the pay and allowances of a major on the active list, and no more.
