Confirm a Provisional Order under the Salmon A.D. 1927. and Freshwater Fisheries Act 1923 relating to the Rivers Ouse and Cam and other waters.

WHEREAS the Agriculture and Fisheries

has made the Provisional Order set forth in the

schedule hereto under the provisions of the Salmon and 13 & 14 Freshwater Fisheries Act 1923:

And whereas it is requisite that the said Order should be confirmed by Parliament:

Be it therefore enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present 10 Parliament assembled and by the authority of the same as follows:

The Minister of Agriculture and Fisheries (in this Order referred to as the Minister") by virtue and in exercise of the 5 powers vested in him under the Salmon and Freshwater Fisheries Act 1923 (in this Order referred to as the Act") with a view to the maintenance improvement and development of the trout and freshwater fisheries in the area defined by this Order hereby makes the following Order for the regulation of such fisheries in 10 that area

DEFINITION OF FISHERY DISTRICT AND CONSTITUTION OF

FISHERY BOARD.

1.-(1) This Order applies to the area described in the schedule hereto and more particularly delineated on a map 15 sealed by the Minister in relation to this Order and to all trout and freshwater fisheries therein and such area is hereinafter referred to as "the Fishery District."

(2) If there is any discrepancy between the said map and schedule the map shall prevail.

(3) A copy of the said map certified under the Documentary Evidence Acts 1868 to 1895 shall be kept by the Fishery Board for the Fishery District at the office of the clerk of that Board and be open at all reasonable times to inspection free of charge by any person desiring inspection for any bona fide purpose.

2. The Fishery Board for the Fishery District shall consist of the following members :

(a) Members appointed by the county councils of counties in the Fishery District.

Sections 46 and 88 of the Act shall apply to appoint- 30 ments of such members with the limitation that each county council shall appoint one member only.

(b) One member appointed annually by the Ouse Drainage Board and one member appointed annually by the Norfolk Court of Sewers.

(c) Members representative of the interests of persons fishing A.D. 1927. with rod and line for trout or freshwater fish.

The number of such members shall be as follows that

(i) In the case of the first appointments to be made ten.

(ii) In the case of subsequent appointments :

(1) If the aggregate amount of duties for licences for fishing with rod and line for trout or freshwater fish as certified in accordance with the provisions of section 48 subsection (4) of the Act does not exceed the sum of five hundred pounds ten.

(2) If such aggregate amount exceeds the sum of five hundred pounds one additional member for every additional fifty pounds or part of fifty pounds.

Up to and including the year nineteen hundred and twenty-eight all appointments of such members (other than appointments to fill casual vacancies) shall be made by the Minister Thereafter such members shall be elected or appointed in accordance with a scheme if any which shall have been sanctioned by the Minister in that behalf or if there is no such scheme then by the Fishery Board with the approval of the Minister.

In the case of the first appointments as herein pro-
vided the members so appointed shall hold office until
the thirty-first day of January nineteen hundred and
twenty-seven and in all other cases (except appoint-
ments to fill casual vacancies) the members shall be
appointed or elected as herein provided annually and
shall hold office for one year provided that if at the
date when the term of office of any such member is
due to determine no successor has been appointed such
member shall continue to hold office thereafter until a
successor is appointed.

(d) Ex-officio members who shall be persons qualified to act
as such under either of the qualifications specified in
section 50 of the Act.

LICENCES FOR FISHING FOR FRESHWATER FISH.

3.-(1) The provisions of sections 61 to 64 inclusive of the Licences to Act shall subject to the modifications hereinafter specified fish for apply to all freshwater fish within the Fishery District in like freshwater fish. manner as they apply to trout Provided that no person under

A.D. 1927. the age of fourteen shall be required to pay licence duty for fishing for freshwater fish with rod and line.

Application

(2) Unless and until fresh licence duties for fishing for trout or freshwater fish are determined and approved under and in accordance with the provisions of section 61 of the Act such 5. licence duties shall be as follows that is to say :

(3) A licence to fish for trout or freshwater fish shall not be 15 available after the thirty-first day of December in the year in which it is issued.

POWERS OF FISHERY BOARD.

4. The provisions of the Act with respect to Fishery Boards of provisions and Fishery Districts except as herein otherwise expressly pro- 20 of the Act. vided and so far as they are consistent with the provisions of this Order shall apply to the Fishery Board for the Fishery District and the Fishery District and the Fishery Board shall as regards the Fishery District have all such powers and duties as may be exercised or discharged by a Fishery Board under that Act.

5. The certificate of the Home Office dated the fifteenth day of July eighteen hundred and eighty-six constituting the Ouse and Nene Fishery District and the certificate of the Board of Trade dated the twenty-seventh day of October eighteen 30 hundred and eighty-seven constituting the Norfolk and Suffolk Fishery District and all byelaws heretofore in force within those districts shall cease to have effect and the existing Fishery Boards for those districts shall be abolished as from the date of confirmation of this Order.

6. The costs incurred by the applicants in obtaining this Order shall be paid out of any funds in the hands of the Fishery Board constituted by this Order.

7. This Order may be cited as the Ouse and Cam District Fishery Order 1926.
