(4) No such order shall come into force until the expiration of fourteen days from the date on which it was made, or, where notice of appeal is given against it, until the appeal has been decided or withdrawn.

4. (1) The local supervising authority may make 5

byelaws

(a) prescribing the records to be kept of the patients
received into a nursing home, and, in the case
of a maternity home, of the children born
therein and of the children so born who are 10
removed from the home otherwise than to the
custody or care of any parent, guardian, or
relative;

(b) requiring notification to be given of any death
occurring in a nursing home together with a 15
statement of the cause thereof.

(2) The provisions of sections one hundred and 38 & 39 Vict. eighty-two to one hundred and eighty-six of the Public Health Act, 1875, shall, so far as they relate to byelaws made by an urban sanitary authority, apply to byelaws 20 made under this section.

Inspection of nursing homes.

(3) If any person acts in contravention of or fails to comply with the provisions of any byelaw made under this Act, he shall be guilty of an offence against this Act.

5.-(1) An officer duly authorised by the local supervising authority may, subject to such regulations as may be made by the authority, at all reasonable times enter and inspect any premises which are used, or which that officer has reasonable cause to believe to be used, 30 for the purposes of a nursing home, and to inspect any records required to be kept in accordance with the provisions of this Act:

Provided that nothing in this Act shall be deemed to authorise any such officer to inspect any medical 35 record relating to any patient in a nursing home.

(2) If any person refuses to allow any such officer to enter or inspect any such premises as aforesaid or to inspect any such records as aforesaid, or obstructs any such officer in the execution of his powers under this 40 section, he shall be guilty of an offence against this Act.

6. (1) A local supervising authority may grant A.D. 1927. exemption from the operation of this Act in respect of any hospital or institution not carried on for profit.

Power to exempt

(2) Any exemption granted under this section in certain in5 respect of any hospital or institution shall continue in stitutions. force for one year only from the date on which it is granted, but without prejudice to the power of the local supervising authority to grant any further exemption in respect of that hospital or institution.

(3) Any person who is aggrieved by the refusal of a local supervising authority to grant exemption under this section in respect of any hospital or institution, or by the withdrawal by the authority of any such exemption, may appeal against the refusal or withdrawal to the 15 Minister of Health, and the Minister, after considering the matter, shall give such directions therein as he thinks proper, and the authority shall comply with any directions so given.

7.-(1) If any person is guilty of an offence against Penalty for 20 this Act (other than an offence in respect of which some offences other penalty is specifically provided by this Act) he against Act shall in respect of each offence be liable on summary sion as to and proviconviction to a fine not exceeding five pounds, and, in offences by the case of a continuing offence, to a further fine not companies. 25 exceeding two pounds in respect of each day on which the offence continues after conviction.

(2) Where a person convicted of an offence against this Act is a company, the chairman and every director of the company and every officer of the company con30 cerned in the management thereof shall be guilty of the like offence, unless he proves that the act constituting the offence took place without his knowledge or consent.

8. (1) For the purposes of this Act the council of Local suevery county as respects that county, and the council of pervising 35 every county borough as respects that borough, shall be authority. the local supervising authority.

(2) Any expenses incurred by the council of a county under this Act shall be defrayed as expenses for general county purposes, and any expenses incurred by a county 40 borough under this Act shall be defrayed out of the borough fund or rate, or in the case of a borough having a consolidated rate or general rate fund, out of the consolidated rate or general rate fund.

(3) Any fees received by the council of a county under this Act shall be paid into the county fund, and any fees received by a county borough under this Act shall be paid into the borough fund or, in the case of a borough having a general rate fund, into the general 5 rate fund.

9. In this Act, unless the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them, that is to say,—

"Register" and "Registration" mean register and 10 registration under this Act:

Nursing home" means any premises used or intended to be used for the reception and the providing of nursing for persons suffering from any sickness, injury, or infirmity, and includes 15 a maternity home but does not include

(i) any hospital or other premises maintained or controlled by a Government department or local authority or by any other body of persons constituted by special Act of Par- 20 liament or incorporated by Royal Charter;

(ii) any institution for lunatics within the meaning of the Lunacy Act, 1890;

(iii) any certified institution, certified house
or approved home within the meaning of the 25
Mental Deficiency Act, 1913:

Maternity home" means any premises used or
intended to be used for the reception of pregnant
women or of women immediately after child-
birth:

Qualified nurse" means a person registered in the
general part of the register of nurses required
to be kept under the Nurses Registration Act,
1919, or a person who had before the com-
mencement of this Act completed a three 35
years' course of training in a hospital which
was during the period of her training, or
subsequently became, a training school ap-
proved by the General Nursing Council for
England and Wales, or the General Nursing 40
Council for Scotland, or the General Nursing
Council for Northern Ireland, for the purpose
of admission to the general part of the said
register :

“Pupil midwife" means a person who is undergoing A.D. 1927.
training with a view to becoming a certified
midwife, and for that purpose attending women
in childbirth as part of a course of practical
instruction in midwifery recognised by the
Central Midwives Board.

10. (1) This Act may be cited as the Nursing Short title,
Homes Registration Act, 1927.

(2) This Act shall not apply to Scotland or Northern peal and
10 Ireland.

(3) Subject as hereinafter provided, so much of
any local Act as makes provision for the registration of
any nursing home within the meaning of this Act is
hereby repealed, and the enactments mentioned in the
15 Schedule to this Act are hereby repealed to the extent
specified in the third column of that Schedule:

Provided that any person who is immediately before
the commencement of this Act registered under any
enactment repealed by this Act in respect of any mater-
20 nity home, shall, as from the commencement of this
Act, be deemed for all the purposes of this Act to be a
person duly registered thereunder in respect of that
home.

(4) This Act shall come into operation on the
25 first day of January, nineteen hundred and twenty-eight.
