by any officer or member thereof whereby any exclusive or preferential right to supply intoxicating liquor or any kind of such liquor for the use of the club shall be conferred or attempted to be conferred upon any person or 5 body engaged or pecuniarily interested in the business of the manufacture or sale of such liquor or any business connected therewith or ancillary thereto;

or

(b) That the club premises for the time being shall 10 not at any time be mortgaged to or charged in favour of any person or body engaged pecuniarily interested in any such business and that no lease of any club premises nor any interest in such premises (other than an absolute 15 interest free from any condition) shall at any time be taken or acquired from any person or body so engaged or interested;

(c) That no intoxicating liquor shall on the club premises be sold or supplied to any person for 20 consumption off the premises;

(d) That no intoxicating liquor shall on the club premises be sold or supplied to or permitted to be consumed by any person under the age of eighteen years;

(e) That the hours during which intoxicating liquor
may be sold or supplied in the club premises
shall be the hours for the time being fixed by
order of the licensing justices of the licensing
district in the case of licensed premises except 30
so far as those justices may by special order in
relation to the club vary the hours so fixed
(within the limits imposed by the Licensing
Act, 1921) on the ground that the special
requirements of the club render such variation 35
desirable;

(f) That the number of honorary members shall not
at any time exceed twenty-five per cent. of the
number of ordinary members;

(g) That no person shall be admissible as a member 40 of the club (whether temporary or otherwise) unless an interval of at least fourteen days shall

(h) That proper books of account shall be kept of the
receipts and expenditure of the club and shall
distinguish under separate heads (i) members'
subscriptions, (ii) subscriptions from affiliated
clubs, (iii) moneys received from sales of intoxi-
cating liquor, (iv) moneys received from sales of
other refreshments and commodities, and (v)
moneys expended upon the purchase of intoxi-
cating liquor for the use of the club.

5. 6. (1) Any police officer of a rank not inferior to Entry on that of inspector may for the purpose of preventing or detecting any violation of any of the provisions of the premises by principal Act or this Act at all times enter on the superior premises of a club: Provided that an officer when officers. 30 acting under this section shall not wear uniform.

(2) If any person by himself or by any person in his employ or acting by his direction or with his consent refuses or fails to admit any officer demanding to enter in pursuance of this section, that person shall be liable in 35 respect of each offence to a fine not exceeding in the case of the first offence five pounds and in the case of any subsequent offence ten pounds.

in relation to the preceding year particulars of the receipts of the club from (a) members' subscriptions, (b) subscriptions from affiliated clubs, (c) proceeds of sale of intoxicating liquor, and (d) proceeds of sale of other refreshments 5 and commodities, and a duplicate of the annual statement of purchases of intoxicating liquor as submitted to the Commissioners of Customs and Excise in pursuance of section forty-eight of the Finance (1909-10) Act, 1910: (2) Section ninety-four thereof shall be read and construed as if the words "except to a member on the premises were omitted therefrom: (3) The following paragraph shall be substituted for paragraph (e) of subsection (1) of section 15 ninety-five thereof :

"(e) That the club is habitually conducted or used mainly for the purpose of supplying and obtaining intoxicating liquor."

(4) The following paragraph shall be inserted imme- 20

(c) To the extent in quantity and value of the purchases for the use of the club of intoxicating liquor during the twelve months previous to the complaint, and the ratio which the receipts of the club from the sale 40 of intoxicating liquor bear to the receipts for subscriptions and from the sale of

(6) Where on the hearing of a complaint under the
said section ninety-five in respect of any club
any of the grounds mentioned in subsection (1)
of that section as amended by this section has
been established to the satisfaction of the court
but the court has not made an order under
that subsection, then if on the hearing of a
subsequent complaint the same ground be
again so established the court shall make an
order directing the club to be struck off the
register, but any order made in pursuance of
this enactment shall be subject to appeal to
quarter sessions, and sections twenty-nine to
thirty-two of the principal Act shall apply to
every such appeal with the substitution of
references to the court from which the appeal
is made and the area of the jurisdiction of that
court for references to the licensing justices
and the licensing district for which they act
and of a reference in subsection (1) of section
twenty-nine to the order under this enactment
for the reference to the refusal to grant a
renewal, transfer or special removal and with
the omission from subsection (4) of that section
of all words after the word "fit."

8. (1) This Act may be cited as the New Clubs Short title, Act, 1927.

(2) This Act shall be construed as one with the Licensing Acts, 1910 to 1923, and those Acts and this Act may be cited together as the Licensing Acts, 1910 to 1927.

(3) This Act shall come into operation on the first 35 day of January, nineteen hundred and twenty-eight, and shall apply to any club requiring to be registered under the principal Act other than a club so registered before that day.

(4) This Act shall not extend to Scotland or 40 Northern Ireland.
