Bill intituled an Act to make such amendments of the Workmen's Compensation Act, 1925, as are necessary to give effect to a certain resolution adopted by an Imperial Conference held in London in the year nineteen hundred and twenty-six. 999 A BILL ΤΟ ORD LIBRARY Amend the Law relating to the registration of A.D. 1927. BE E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows: : 1.-(1) No club to which this Act applies shall be Certificate registered under the Licensing (Consolidation) Act, 1910 to precede (hereinafter referred to as "the principal Act"), unless registration. and until a certificate stating that such club is fit for 10 registration has been granted under this Act. 15 (2) If any person registers or applies for the registration of a club in respect of which such a certificate has not been granted he shall be liable to a fine not exceeding twenty pounds. 2. (1) A certificate under this Act may be granted Application by the licensing justices of the licensing district in for and which the club premises or intended club premises grant of are situate. (2) An application for such certificate may be made 20 by the secretary of the club and shall be sent in writing to the clerk to the licensing justices and shall be accompanied by the like particulars and statement as are by subsection (3) of section ninety-two of the principal Act certificates. A.D. 1927. required to be furnished with the return therein mentioned and by a list of the persons who are, or have signified their intention to become, members of the club, and the application and each of the said accompanying documents shall be signed by the applicant. 5 (3) Applications for certificates under this Act shall be heard by licensing justices at their general annual licensing meeting, or at any adjournment thereof, or they may hold a special meeting for the purpose of dealing with such applications. The clerk to the licensing 10 justices shall within five days after those justices have appointed the day, hour and place for holding any such special meeting send notice thereof to the superintendent of police of the district, and such superintendent shall cause a copy to be fixed on the door of the church or 15 chapel of any parish in the district, or where there is no such church or chapel on some other public and conspicuous place in the parish. (4) The applicant shall within three days after making the application insert in at least one newspaper circulating 20 in the licensing district and serve upon the superintendent of police of the district a notice stating that the application has been made. Such notice shall set forth the name and address of the applicant and the name of the club, and shall identify the club premises. (5) On the hearing of the application any person shall be entitled to appear and to support or oppose the same. 25 (6) A certificate under this Act shall not be granted unless the licensing justices (or on appeal the court of 30 quarter sessions) are satisfied (a) that the club premises or intended club premises are suitable for the purposes of a club at which intoxicating liquor is to be supplied; and (b) in the case of premises which at any time pre- 35 (c) that no covenant, agreement or obligation has 40 thereof whereby any exclusive or preferential. (d) that the club premises or intended club premises (e) that the rules of the club include the statutory (f) that no circumstance exists or is likely to occur sessions. 3.-(1) Any person who thinks himself aggrieved by Appeal to the grant or refusal by the licensing justices of a certificate quarter 25 under this Act may appeal against the grant or refusal to the court of quarter sessions, and sections twenty-nine to thirty-two of the principal Act shall apply to every such appeal with the substitution in subsection (1) of section twenty-nine of a reference to a grant or refusal 30 of a certificate for the reference to the refusal to grant a renewal, transfer or special removal of a justices' licence and with the substitution in subsection (4) of that section for all words following the word "appeal" of the words "and make an order with or without costs, as the court 35 think fit, for the refusal or grant of the certificate." (2) During the pendency of an appeal under this section the operation of any order of the licensing justices for the grant of the certificate shall be suspended. 4.
