CIVIL PAY (ARREARS)

Amount estimated to be required in the year ending
31st March, 1925, for the payment of balance of civil
pay to those Civil Servants who served with H.M. Forces
during the Great War and whose cases are covered by
the judgments delivered by the Court of Appeal (4th-
6th November, 1924) in the matter of the Petitions of
Right of Messrs. Pidduck, Rudderham, Atkins, Cameron,
Jordan, and Alexander, following the judgment of the
House of Lords in the case of Sutton v. Rex.
The general effect of those judgments is that War Bonus
must be regarded as forming part of the civil pay offered
to certain Civil Servants as a condition of their voluntary
enlistment. In the case of single men generally who
enlisted under an offer of balance of civil pay, and of
both single and married men in the Post Office who
enlisted under an offer of full civil pay, War Bonus was
not taken into account in calculating civil pay, and the
provision now made is for payment of the difference
between the pay already granted and that due on the
basis of War Bonus ranking as part of civil pay.

The total expenditure under the judgments in question is estimated at £3,785,000. Expenditure in respect of the Admiralty, the War Office and the Air Ministry will be met from Navy, Army and Air Votes respectively. Any payments falling to be made by Civil and Revenue Departments after 31st March, 1925, will be met from the ordinary Departmental Votes for 1925-6.

The total expenditure under the judgment of the House of Lords in the case of Sutton v. Rex, which was met from the Post Office Votes for 1923-4 and 1924-5, was approximately £1,236,000.

An Appropriation Account for this Vote will be prepared by the Treasury, and will show the amount issued to each Department: the Departments will account to the Treasury for the amounts issued to them from the Vote.
