accounts and buildings of the hospital and all internal affairs, and maintain discipline therein, and enforce compliance with, and obedience to, all rules, by-laws and regulations adopted by the board of managers for the government, discipline and management of said hospital, and the employees and inmates thereof. He shall make and enforce such further rules, regulations and orders as he may deem necessary, not inconsistent with law, or with the rules and regulations of the board of managers.

3. Appoint such employees as he may think proper and necessary for the efficient performance of the business of the hospital, and prescribe their duties; and may discharge any such employee at his discretion after having given notice in writing of the cause of the proposed removal and opportunity to be heard thereon.

4. Cause proper accounts and records of the business and operations of the hospital to be kept regularly, from day to day, in books and on forms provided for that purpose; and see that such accounts and records are correctly made up for the annual report to the board of supervisors, as required by subdivision nine of section three of this act, and present the same to the board of managers, who shall incorporate them in their annual report to the said board.

5. Receive into the hospital, under the rules established by the board of managers, any person in the county of Oneida who is sick or maimed or injured and who is in need of hospital care, irrespective of whether such person is able to pay for his care or not; and may also receive persons from without the county, provided there is a vacancy in the hospital, and providing the reception of such persons does not interfere with the proper care and treatment of persons received from the county.

6. Cause to be kept proper records of the admission of all patients, their name, age, sex, color, marital condition, residence, occupation, place of last employment and the names and addresses of their nearest relative or friends. He shall also cause a careful examination to be made of the physical condition of all persons admitted to the hospital; and shall cause a record to be kept of the condition of each patient when admitted, and from time to time thereafter.

7. Discharge from said hospital any patient who is found to

have recovered from his illness sufficiently to be no longer in need of hospital care, or who shall willfully or habitually violate the rules thereof, or who for any other reason is no longer a suitable patient for treatment therein; and shall make a full report thereof at the next meeting of the board of managers.

8. Collect and receive all money due the hospital, keep an accurate account of the same, report the same at the ensuing monthly meeting of the board of managers, and transmit the same within ten days after such meeting to the treasurer of the county.

9. Give a bond before entering upon the discharge of his duties, in such sum as the board of managers may determine, to secure the faithful performance of such duties.

§ 5. Admission and maintenance of patients. Whenever a patient shall have been admitted to such hospital, the superintendent shall cause to be made such inquiry as he may deem necessary, relative to the ability of such patient, or of the relatives of such patient legally liable for his support, to pay for his care and treatment. If he find that such patient, or said relatives, are able to pay for his care and treatment in whole or in part, an order shall be made by the superintendent directing such patient, or said relatives, to pay to the treasurer of such hospital for the support of such patient a specified sum per week, in proportion to their financial ability, but such sum shall not exceed the actual cost of maintenance. The superintendent shall have the same power and authority to collect such sums from the patient, or his relatives legally liable for his support, as is possessed by an overseer of the poor in like circumstances. If the superintendent find that such patient, or said relatives, are not able to pay, either in whole or in part, for his care and treatment in such hospital, the unpaid cost of his maintenance shall become a charge upon the county of Oneida; provided, however, that in case such patient is not a resident of said county, the cost of his maintenance shall be a charge upon the civil division of the state upon which he would be a charge as a poor person. No employee of such hospital shall accept from any patient thereof any fee, payment or gratuity whatsoever for his service.

§ 6. Training school for nurses. The board of managers may establish and maintain in connection therewith and as a part of the public hospital a training school for nurses. The board may, in its discretion, appoint an advisory board for such training school and define the functions of such advisory board.

§ 7. Visitation and inspection. Members of the board of managers shall be admitted to every part of the hospital and premises, and shall have access to all books, papers, accounts and records pertaining to the hospital and shall be furnished with copies, abstracts and reports whenever required by them. The hospital shall be subject to inspection by any duly authorized representative of the state board of charities, of the State Charities Aid Association, and of the board of supervisors; and the resident officer in charge shall admit such representatives into every part of the hospital and premises, and give them access on demand to all records, reports, books, papers and accounts pertaining to the hospital.

Poughkeepsie City Tuberculosis Hospital.

AN ACT to permit the city of Poughkeepsie to establish, equip, and maintain a tuberculosis hospital, and to permit the county of Dutchess to make appropriations therefor.

Chapter 465, Laws of 1910.

Section 1. 1. The city of Poughkeepsie shall have power to accept gifts for, and to establish, equip and maintain outside of its corporate limits, but within the county of Dutchess, subject to the consents required by section three hundred and nineteen of the public health law, a hospital for the regular treatment of residents of the city of Poughkeepsie and the county of Dutchess for the disease known as pulmonary tuberculosis, which hospital shall be under the management, control and direction of a board of seven trustees of whom one shall be the mayor of the city of Poughkeepsie, ex officio, one the health officer of such city, ex officio, and one a member of the board of health of such city, designated annually in January by resolution of the board of health. The remaining four trustees shall be Grace N. Kimball, physician of

the city of Poughkeepsie, trustee for four years; Nettie M. Bowne, widow of Samuel W. Bowne, trustee for three years; John K. Sague, banker, of the city of Poughkeepsie, trustee for two years, and Albert C. Rust, builder, of the city of Poughkeepsie, trustee for one year. The terms of such trustees shall begin as of January first, nineteen hundred and fourteen. In December of each year, the seven trustees shall elect by majority vote of the whole board, a trustee whose term of office shall be for four years from the first of January following such election. If the place of the member designated by the board of health shall become vacant at any time, such board shall appoint one of its members to fill such vacancy for the unexpired term. A vacancy in the place of any trustee, except the mayor, health officer and board of health member, shall be filled for the unexpired term by a vote of a majority of the whole board of trustees in office. The board of trustees shall have power to make and amend rules and regulations for the conduct, control and management of such hospital and the admission of persons thereto, and to fix the amount to be charged for treatment, care and observation of patients.

2. In admitting persons to such hospital for care and treatment or observation, the trustees shall give preference first to the residents of the city of Poughkeepsie designated by the physicians of such city; second, to such residents of Dutchess county outside of the city of Poughkeepsie as shall be recommended by their family physicians; third, such persons residing outside of Dutchess county as they deem proper. In the case of indigent patients, those from the city of Poughkeepsie shall also be recommended by the health officer of such city, and those from the county of Dutchess by the supervisor of the town in which they reside. Any indigent patient recommended as above and received by the hospital shall upon admission become and be a city or county charge according to the place of his residence.

§ 2. 1. On or before the first day of October in each year, the board of trustees shall estimate and certify to the common council of such city the amount of money required for the maintenance of such hospital for the next year, stating in detail so far as practicable, the purpose for which the money is required. The

common council shall cause such estimate to be published in one or more daily newspapers published in such city one week before action shall be taken by such council. The common council is hereby authorized to revise such estimate and cause the amount thereof, or so much thereof as it shall deem necessary, to be raised by general tax upon all taxable property of such city.

2. The board of trustees shall on the thirty-first day of December make to the common council of such city a report of its operations for the fiscal year, containing an account of all moneys received by it during the fiscal year, the source from whence received, an account of all expenditures and of all debts incurred by it, the amount of debts unpaid and the objects for which such debts were incurred; the number of persons admitted to and discharged from such hospital and the number of persons still remaining in its care for treatment, residents of the city of Poughkeepsie, the number of persons admitted to and discharged from such hospital and the number still remaining in its care for treatment, residents of the county of Dutchess, the number of persons admitted to and discharged from such hospital and the number remaining in its care for treatment, who are neither residents of the city of Poughkeepsie nor the county of Dutchess, and the number of indigent persons from the city of Poughkeepsie admitted and discharged from such hospital and the number remaining in its care. The fiscal year of such hospital shall begin on the first day of January.

§ 3. 1. The board of supervisors of the county of Dutchess are hereby authorized to make appropriations for the establishment, equipment and maintenance of said hospital, and to make agreements and terms with the local board of health of the city of Poughkeepsie for the admission, care, support and maintenance in said hospital of indigent and other patients residing in the county of Dutchess outside of the city of Poughkeepsie, and the amount fixed by such agreements to be paid for the support, care and treatment of any indigent patient admitted from the county of Dutchess outside of the city of Poughkeepsie shall be a county charge upon the county of Dutchess outside of the city of Poughkeepsie.
