The council have the pleasure to report that, at the recent election of members of the council of the Incorporated Law Society, Mr. Lewis Fry, M.P., a member of the council of this society, was elected an ordinary member of the council of the chief law society. Law Students' Journal. LAW STUDENTS' DEBATING SOCIETY. The weekly meeting of this society was held at the Law Institution, Chancery-lane, on Tuesday evening last, Mr. G. H. Bower in the chair. The subject appointed for the evening's debate was "Has the policy of the Government in regard to the affairs of Turkey deserved approval ?" and was opened by Mr. Van Sommer in the affirmative. Messrs. E. R. Carr, LL.B., Corrie, Grant, Napier, Bartlett, and Green, then addressed the society in the affirmative; and Messrs. Farlow, Hemsley, Lloyd, Jones, Raymond, Barker, and Barry, in the negative. Mr. Van Sommer having replied, the question being put to the meeting was decided in the affirmative by twelve votes to nine in the negative. There was a large attendance of members. UNITED LAW STUDENTS' SOCIETY. A meeting of this society was, on Monday, the 25th inst., held at the Law Institution, Mr. H. E. Barren in the chair. The question for discussion was: "The Criminal Code Bill, 1880, s. 24, enacts that No presumption shall be made that a married woman committing an offence does so under compulsion because she commits it in the presence of her husband.' Is this alteration desirable?" Mr. Pickersgill opened in the affirmative, and was supported by Messrs. R. Maxwell and Donner, and opposed by Messrs. Samuel, MacLaren, and Rundle Levey. Mr. Pickersgill replied and, upon a division, the question was decided in the negative by one vote. The usual weekly meeting of this society took place at Clement's-inn, on Wednesday, the 27th inst., Mr. W. C. Owen in the chair. The motion on the paper was: "That the present standard of compulsory education is needlessly high." Mr. Maxwell moved the rejection of the motion and was supported by Messrs. MacLaren, Bull, Napier, Pickersgill, and Donner, and opposed by Messrs. Acland, Collyer, McKay, Kains-Jackson, and Spence. Mr. Maxwell replied and, upon a division, the motion was lost by a majority of two votes. MANCHESTER LAW STUDENTS' SOCIETY. The general meeting of the society was held on Tuesday evening, the 26th inst., at the Law Library, Cross-street, E. Atkins, Esq., solicitor, in the chair. The honorary secretary, Mr. T. W. Mr. W. Coxwell was admitted a solicitor in 1870, and is deputy-coroner for Southampton. Mr. CHARLES JOHN HERRIES, barrister, C.B., has been created a Civil Knight Commander of the Order of the Bath. Sir C. Herries is the eldest son of the Right Hon. John Charles Herries, and was born in 1815. He was educated at Eton and at Trinity College, Cambridge, and he was called to the bar at the Inner Temple in Michaelmas Term, 1840. He has been chairman of the Board of Inland Revenue since 1877. Mr. W. S. William Stockdale, vicar of Mears Ashby, and was born in 1822. T. B. DANIEL, Esq., Q.C., Judge.) Oot. 22.-Leathley v Hodgson. This action was brought by Benjamin Leathley, accountant, South-parade, Leeds, to recover from Jabez Hodgson, painter, of Blackpool, formerly of Pudsey, the sum of £25 88. 10d., for professional services rendered. Derser, appeared for the plaintiff. Tunnicliffe, for the defendant, said the case was one in which the accountant had been doing the work of a solicitor in an estate in liquidation. Derser stated that only part of the work was that of a solicitor, the remainder being accountant's work. Tunnicliffe said the defendant had found himself in difficulties, and the plaintiff, being at his house and being friendly with him, suggested that he should make a composition, and said he would undertake to do the work in connection with the composition. That composition was not carried out, and in November or December, 1878, the defendant filed a petition for liquidation, and the plaintiff was appointed receiver. Derser said the plaintiff would tell the court that he advised the defendant to have a solicitor, but the defendant said he would not go to the expense which would be incurred in having a solicitor. His HONOUR said the plaintiff might have told the defendant that he was not a solicitor, and could not do solicitor's work. Having examined the statement of claim, his Honour said that as receiver the plaintiff had no authority whatever to do certain of the work in respect of which he had made a claim. Where a receiver was appointed, his duty was to take care of the property of the debtor until the first meeting of creditors, and then his business as receiver was at an end. What charges he might be entitled to as receiver would be allowed when the bill had been passed by the registrar. An accountant could not practise in a Court of Bankruptcy; but whether that was a matter for any penalties under existing Acts of Parlia ment he did not know. The only persons who were qualified to practise in the Bankruptcy Court were counsel and solicitors. An accountant had no right to practise in a Court of Bankruptcy, or to do work which was properly the work of a solicitor, who was responsible to the court in which he practised for any misconduct or negligence of which he was guilty, while an accountant for such a purpose was merely a man taken out of the streets. Derser stated that the plaintiff had advised Hodgson to have a solicitor. His HONOUR observed that that was the strongest evidence against the plaintiff, who knew that a solicitor was required. Derser said the defendant made a contract to pay the plaintiff. His HONOUR: I reserve to myself the right of believing it. This is a case of an ignorant person who is in difficulties, and has put himself into the hands of an unqualified person, for the purpose which he required, to administer his affairs through the Court of Bankruptcy. Derser remarked that a composition had been paid. His HONOUR said there was a composition of 2s. 6d. in the pound, which it appeared from the accountant's own bill had been procured by his act of intervention in applying to the creditors for the purpose of controlling and influeneing their proceedings in order to carry a composition. This was one of the abuses to which the Comptroller in his report bad called special attention-the mode in which creditors' meetings were got up by unprofessional persons. When it was seen that at the first meeting there was a sufficient majority to carry a composition, then the resolutions were brought forward. The second meeting would be held as a certainty, because a simple majority carried a composition. The resolutions of composition were not put forward at the first meeting until care had been taken to manipulate the attendance so that there was a sufficient majority of friends of the debtor to carry the resolutions This case was an illustration of the mode in which tha was done. The administration of insolvent estates was virtually placed in the hands of the creditors, who were so negligent of their own interests that they encouraged—and to a certain extent were responsible for-those illegitimate proceedings of which there was now the loudest complaint. The best mode of administration was through the creditors, when they would do their duty; but when they would not do their duty, and when, hearing of a petition, they considered it a bad debt, and trusted to anything they got as something they could carry to profit and loss account, it became a consideration with him, after ten years' experience, whether some farther official control should not be introduced. He would adjourn the case to give the plaintiff an opportunity of laying his bill before the registrar, who would certify whether anything, and what, was due in respect of services for which he was entitled to charge as an accountant. The case was adjourned until the 26th of November, the question of costs being reserved.
