Mr. Baron Huddleston, at the sitting of the Exchequer Division on Wednesday, announced that the Lord Chief Baron, owing to the serious illness of one of the members of his family, had been unexpectedly called to the south of France, and that the sittings at Nisi Prius in the division would therefore be postponed until next week. The case of Moody v. Steggles, says an American legal journal, involved the question of the right of one to maintain a metal sign affixed to the house of another, it having been so affixed for forty years. The court in delivering judgment gravely remarked: "It is said that the signboard creaks, and that the plaintiffs have no right to cause the annoyance which is produced by the creaking of the signboard. Now, it appears to me, from the evidence, that the signboard, if I may use such an expression, creaks from its own nature. It is not easy, and probably not possible, to expose a wide surface of metal, such as this signboard appears to be, to the action of the wind down this passage without causing some creaking, and it appears to have always creaked more or less. But the evidence goes to show that in the spring of last year it creaked rather more than usual, and then an interview took place between Mr. Vaughan, who was specially affected by it, and the plaintiff, Miss Moody, in which she seems to have offered him the use of the ladder, and to have invited him to grease it himself, which invitation he refused. The whole thing with regard to the creaking is of a trumpery description. It does not appear to me that there has been any creaking in excess of what is naturally incidental to a signboard, and certainly in the later exercise of the right the plaintiff has studiously desired to minimise the inconvenience to the defendant, because it has been erected with indiarubber washers, which undoubtedly have diminished the noise to the greatest possible extent. Therefore, that defence appears to me to be insignificant and idle." Sir Richard Kindersley expressly repudiated the ground that there was any distinction between a general power to appoint by deed or will, and one by will only, the power being exercised. He decided on reasons applicable to every case of a general power of appointment. The judgment of Lord Justice Turner in Johnson v. Gallagher (9 W. R. 506, 3 De G. F. & J. 517) and the case of London Chartered Bank v. Lempriere (21 W. R. 513, L. R. 4 P. C. 572) have displaced Vice-Chancellor Kindersley's view of the law, but the last-named decision had reference to the case of a general power exerciseable by deed or will. It therefore still remained open to argue that where the property was not disposable by act inter vivos, the creditors were not let in. The reason for subjecting property in that predicament to the claims of creditors would be, not that the limitation gave the married woman in effect an absolute ownership, but an analogy to the equity which makes a man's debts payable out of funds subject to his general power of appointment actually exercised. Now, the Chartered Bank v. Lempriere went on the ground of substantial ownership. Thus the authorities stood in a curious position; the principle of the decisions in point opposed to the liability had been overruled, but the principle of the later decisions did not cover the present case. It was reasonably to be expected, however, that the analogy of the equity affecting property appointed by a man under a testamentary power would be applied. The difference be |
