The practice of supplying persons, in country districts especially, with mineral oils for domestic use from carts and vans prevails to a very great extent throughout the kingdom. In some districts in Kent attention has recently been called to the fact that the Sale of Explosives Act renders the proceeding, as carried out, illegal, as these oils can be moved about only in bottles securely fastened, containing a small quantity each, the aggregate bulk not to exceed three gallons. In these circumstances, applications have been made by persons interested in the sale of these oils for magistrates' licences in respect of carts and vans for the storage of the articles in a manner similar to that for storage upon premises. The clerk of the peace for the county, however, who has been consulted in the matter, has recently given an opinion that the Act contemplates licences being given to persons only in respect of fixed and permanent places of storage, and that a movable vehicle, like a cart, cannot be considered as coming within the meaning of the word "premises." In the Queen's Bench Division on Tuesday, on the occasion of an application to postpone a case in which Mr. Serjeant Parry was counsel, the Lord Chief Justice said there could only be one universal sentiment of the deepest regret at the loss of so eminent and excellent an advocate, and so estimable a member of society, and any arrangement rendered necessary by this sad event would be willingly assented to. Mr. Littler, Q.C. (the senior counsel present), said it was hardly necessary on the part of the bar to express their entire concurrence in the feeling thus expressed by his lordship, but, as a matter of respect to the memory of one whom they all esteemed and loved, he could not help giving expression to the universal feeling of deep regret at the loss of their friend. It is understood that the Attorney-General, with the concurrence of Sir Henry James and other leaders of the profession, wrote to the son of the deceased serjeant expressing the wish of many of the bar, if it were not inconvenient, to attend the funeral, and that this expression of their desire has been very warmly acknowledged and acquiesced in. At the Worcestershire Quarter Sessions a discussion arose on the presentation of the prison report in reference to the imprisonment of debtors. The report stated the objections of the committee to the present mode of imprisonment of debtors, who were not imprisoned because they could not pay, but because they refused to pay after an order of the county court made on proof of their ability to comply with it. They considered that "if imprisonment is to be retained it should be made effective for the end aimed at, which is to compel payment of the money due. The present system, under which debtor prisoners and others lounge away their time in unrestricted association, is objectionable on the grounds of common sense and of morals alike." Sir R. Harington (county court judge), in supporting the proposition for the reception of the report, gave his official experience of the operation of the Act, and said he had issued forty warrants of commitment and yet not one person had been committed, proving that these forty persons could pay, but would not, except under the pressure of impending imprisonment. A motion was made by Mr. Bartleet for sending a copy of the report to the Home Secretary; but Earl Beauchamp objected, as that would be indorsing the committee's report, which they had not had time to consider, and which was only intended to be laid before the court. He thought it would be undig. nified for the court to thrust their advice on the Secretary of State until he asked for it. Mr. Bartleet's motion on a division was lost by a large majority.
