Mr. Proctor presented the following communication:

To the Honorable the Senate of the Third Session

of the Legislature of the State of Nevada:

The undersigned respectfully represents, that on the sixth day of November, 1866, and for some time prior thereto, he was a qualified elector of the County of Lander, State aforesaid, and has since continued to be, and now is such elector.

2d. That at the general election, held in said County of Lander on said sixth day of November, A.D. 1866, for State and county officers, he received seven hundred and fifty-five (755) votes for the office of State Senator, to fill the alleged vacancy created by the absence from this State of the Hon. M. D. Larrowe, which was the highest number of votes cast at said election for any person then eligible to said office.

3d. That George T. Terry was also voted for at said election, for said office of State Senator; and, as he is informed, received from the County Clerk of the said County of Lander County a certain writing, purporting to certify in substance that said Terry had been duly elected to said office, upon the faith of which writing, he is informed, said Terry has been admitted to and is now occupying a seat in said Senate.

4th. That some time prior to said election, the said Terry was duly appointed by S. T. Gage, Esq., United States Tax Collector of the Fourth Collection District, State of Nevada, to the office of United States Deputy Tax Collector, in and for said collection district, the same being a lucrative office under the Government of the United States; that said Terry entered upon the discharge of the duties of said assistant office immediately after his appointment thereto, and continued to hold said office and exercise the duties of the same during and until after the general election, held on the sixth day of November, 1866, by reason of which he, the said Terry, was then, on said sixth day of November, 1866, ineligible to the office of State Senator, aforesaid.

Wherefore the undersigned contests the right of said George T. Terry to the aforesaid office of State Senator, and prays that he, the said Terry, be excluded from said office, and that he, the contestant, be admitted to the same.

Mr. Proctor reported that the Committee on Counties and County Boundaries had had under consideration the Senate Concurrent Resolution No. 19, in relation to the boundaries of the State, and had directed their chairman to report the same back to the Senate and recommend its passage. Mr Sumner reported that the Committee on Ways and Means had had under consideration Senate Bill No. 11, entitled "An Act to amend an Act to provide Revenue for the support [of the Government] of the State of Nevada, and have come to a favorable conclusion thereon, but had directed their chairman to report the same to the Senate, and recommend its reference to the Committee on Judiciary, as it pertains to the issuance of summonses in certain cases.

Mr. Doron from the Standing Committee on State Affairs, to which was referred the bill entitled "An Act in relation to Fines," reported, that they had had the same under consideration, had come to a favorable conclusion thereon, and directed their chairman to report the same to the Senate without amendments, and recommend its passage.

Mr. Proctor reported that the Committee on Counties and County boundaries had had under consideration the Senate Bill No. 14, entitled "An Act for the relief of S. L. Baker," and had directed their chairman to report the same back to the Senate and recommend its passage.

Mr. Stevenson reported that the Committee on Mines and Mining had had under consideration the Senate Bill No. 16, entitled "An Act to repeal an Act entitled An Act concerning the Location and Possession of Mining Claims,'" and had directed their chairman to report the same to the Senate and recommend its passage.

Mr. Hutchins, from the Committee on Military and Indian Affairs, reported that they had had under consideration "An Act to provide Compensation to citizens of this State for Losses and Damages sustained from hostile Indians," and recommend that the same be indefinitely postponed.

Mr. Stevenson reported that the Committee on Mines and Mining had had under consideration the Annual Report of the State Mineralogist, and believing it to be a valuable document, had directed their chairman to recommend that two thousand copies be printed.

The Annual Report of the Warden of the State Prison was received. Mr. Edwards introduced Senate Concurrent Resolution No. 20, ordering the printing of the Report of the Warden of the State Prison.
