WITH REFERENCE to the statement made by the President of the Incorporated Law Society, and contained in our report of the meting of the Law Society held on the 28th ult., it should be mentioned that the new regulations as to the preliminary examination, if not dissented from by the judges, will come into force on the 31st of December, 1887, and apply for the first time to the examination in February, 1888. Mac. & G. 664) and Lincoln v. Windsor (9 Hare, 158) has failed, as we predicted it would. The Court of Appeal has some regard for precedent, even in matters concerning solicitors, and does not quite see its way to the establishment of a system of decision modelled upon that of the Cadi under the palm-tree. The rule in Cradock v. Piper was, the Court of Appeal said, "an established rule of the court, and it was a rule which ought not to be frittered away." And as to the steward's fees, of which Mr. Justice KAY had deprived the trustee solicitor, the Court of Appeal held that, as they were fixed by custom or (in the case of the Lands Clauses Act and enfranchisements, &c.) by statute, and were "not professional charges at all," they should be allowed. A correspondent this week very pertinently inquires whether this doctrine does not apply to those solicitors' charges which are now fixed by statute and scale. On principle it does, but the court's remarks as to "professional charges" should be observed. CONVEYANCERS have been living in a fool's paradise. They have believed that if all proper searches were made against the vendor, especially if they were made under the Conveyancing Act, 1882, the purchaser would be safe against all matters searched for. But they have generally omitted to inquire by what different descriptions the vendor has passed. If, in his purchase-deed, he was described as "of London, Esq.," and at the time of the purchase he was "of Canterbury, a retired Major-General," a very prudent man would search against him under both descriptions, though we believe that this was never done in practice. But suppose that something was entered up against him by his intermediate description of "Captain in H.M.'s 100th Regiment," this would not necessarily be known to apply to him. A prudent solicitor would note this entry, and inquire whether the vendor ever satisfied that description. Now, suppose that an official search is made under the Conveyancing Act, 1882. There appears to be no provision in the rules for describing a person in the requisition for a search by a former abode or former title, so that possibly it would be necessary to make requisitions for two searches in the case we have mentioned, one against "A. B., of London, Esq.," the other against "A. B., of Canterbury, a retired MajorGeneral." Even supposing that the office would allow the abode and title to be entered in the requisition as Canterbury, late London," "a retired Major-General, late Esq.," still the official search would take no cognizance of the intermediate description of Captain in H.M.'s 100th Regiment." The certificate of the result of the search is conclusive in favour of the purchaser; but conclusive of what fact? Simply that no entry exists against his vendor by the description contained in the requisition. The practical conclusion is, that an official search is not quite as safe as a search made by a solicitor in person, and that no solicitor can ever feel certain, however carefully he may make the necessary searches, that he finds everything entered up against the vendor THE COUNCIL of the Incorporated Law Society have issued a new edition of their Digest of Decisions and Opinions on the Remuneration Order, consolidating their original and supplemental digests and containing the cases and opinions since the date of the latter. An improvement in arrangement has been adopted by removing the notes (which have now become, in many cases, of very great length) from the sections of the Act and clauses of the Order and arranging them under divisions referring to the leading provisions of the Order. The book, as it now stands, seems to us a model of its kind and indispensable to solicitors; and its compilers deserve the highest credit for the care, clearness, and accuracy with which the decisions and opinions are stated. Nor would it be just to omit to draw attention to the valuable service which the council have rendered to the profession in giving the extremely numerous opinions embodied in this book and in helping to obtain the decision of the courts on important points connected with the Order. We have sometimes heard a growl about the opinions being of a "cutting-down" type, but it should be remembered that the council do not undertake to say what the remuneration" ought to be, but only what, on the construction of the Order, they think it would be held to be. Our own view is that the opinions, as a whole, are characterized by a good deal more care and consideration and knowledge of the Order than many of the judicial decisions. every entry made against persons bearing the same name as the vendor, whatever may be their descriptions, and then satisfying himself that none of these entries apply to the vendor a course which is clearly impracticable. We may add that, even if he was timid enough to follow this course, he would still not be absolutely safe; the vendor might have changed his name prior to his purchase-deed, a fact of which there would be no trace on the abstract, and something might have been entered up against him in his previous name. THE LIGHT-HEARTED manner in which members of Parliament-unless, indeed, he adopts the ruinously expensive plan of noting propose to create charges on land which are practically undiscoverable, or only discoverable at much expense, by a purchaser, is somewhat surprising. It is stated that Mr. FULTON, M.P., has introduced a Bill "to limit the powers of the water companies to cut off the tenant's water supply where the rate is paid by the landlord." It proposes that where the owner, and not the occupier, is liable by law or by agreement with the water company to the payment of the water rate in respect of a dwelling-house or a part of one occupied as a separate tenement, the water company must not cut off the supply for non-payment of the rate. The rate, with interest thereon at 5 per cent. per annum, is to be a charge on the house in priority to all other charges. We feel certain that if he does so he will receive a large amount of support, and will succeed in modifying the Bill. own.
