It is believed that the practice of charging contract fees is now generally abandoned, but some members of the society still charge auctioneers' fees to purchasers, and it appears to the committee desirable that a distinct recommendation on the latter point should be given by the society for the guidance of its members."

Under these circumstances the resolution may be taken to express the considered opinion of the society, and the committee, therefore, venture to hope that it will be acted upon by all the members of the society, and that they will use their influence with non-members to induce them to follow the same course, so that the practice of the profession may become uniform in this district, and at the same time be brought into harmony with the practice in London and elsewhere. LAW STUDENTS' DEBATING SOCIETY. At the meeting of this society, held at the Law Institution, on Tuesday, the 7th inst. (Mr. R. L. Devonshire in the chair), the question upon the paper for discussion was: "That, in view of the condition of affairs in the East, a defensive confederation of the Balkan States is desirable." Mr. J. Cornelius Wheeler opened the debate in the affirmative, and was followed on the same side by Messrs. T. W. Williams, W. L. Evans, Percy Bone, G. A. Riddell, Woolcombe, Lloyd-Jones, and FodenPattinson, and opposed by Mr. J. D. Crawford. On the chairman putting the motion to the society it was carried by a majority of thirteen votes. There were forty-three gentlemen present, and the debate terminated

at 9.45.

UNITED LAW STUDENTS' SOCIETY.

On the 26th ult. this society held a small social gathering of its members at Anderton's Hotel, Mr. W. S. Shirley, M.P., in the chair. The evening commenced with a dinner, and was followed by an impromptu smoking concert. On the 29th ult. Mr. Ma u proposed that the society

The annual general meeting of this society was held at the Preston Law Library on the 26th ult., Mr. J. Tomlinson, solicitor, in the chair. The report of the committee was read by the hon. secretary (Mr. T. B. Ladyman). It appeared therefrom that the number of members on the roll was sixty-one, of whom thirty-four were honorary and twenty-seven were ordinary members. At the termination of last session there were sixty members, consisting of twenty-eight ordinary and thirty-two honorary; that shewed an increase of one. During the session twenty-six general and special meetings have been held as against twenty-seven of the preceding session, at which the average attendance was fifteen as compared with thirteen of the previous session. Three of the general meetings were presided over by barristers, and the remaining twenty-three by solicitors and ordinary members. Seventeen legal subjects had been discussed as compared with eighteen of the previous session; in addition six general subjects had been discussed, which is the same as during the two preceding sessions. Seventy-two legal queries had been set for solution, of which forty-six had been propounded by committee-men and twentysix by non-committee-men. That system continued to work well. During the year the following members of the society had been successful at the J. Bell, W. Breakell, G. Cartwright, T. H. Clarke, R. Parkinson, and T. D. Penrice; Final: Messrs. W. Bramwell, S. Davies, W. E. Edelston, Mr. R. A. McNab passed the final examination for call and A. T. Plant. to the bar. During the session four joint debates had been held, two with Lancaster and two with Blackburn and District Law Students' Society. The Preston Society had two decisions given in its favour, one against, and one left open. The Preston Society will, during the next session, complete the 100th year of its existence, the original Leguleian Society having been founded in 1787. The thanks of the society were due to the various gentlemen who had occupied the chair, to those who, as honorary members, contributed to its finances, and to the Preston Law Society for their continued kindness in allowing the members the free use of their The adoption of the report was then moved by Mr. Penrice and seconded by Mr. Livesey. Mr. J. Bell, the hon. treasurer, then presented his audited balance-sheet, which was also adopted. The following officers secretaries, Messrs. T. B. Ladyman and G. Cartwright; hon. treasurer, Mr. were then appointed :-President, Mr. T. Humber, barrister-at-law; hon. Walter Breakell; committee, Messrs. J. Bell, T. H. Clarke, A. W. Ladyman, W. Preston, and the hon. secretaries and treasurer. A vote of thanks was then given to the gentlemen who had acted as officers during the session, and also to the chairman for presiding. The proceedings were then brought to a termination.

BRISTOL LAW STUDENTS' SOCIETY.

The first meeting of the session was held on October 12, Mr. T. Parr, solicitor, in the chair. The resignations of eight members were tendered and accepted, and twelve new members were elected. The prize essays on "Fraud in relation to Contract" were read by Mr. H. Holmes Gore (on behalf of Mr. J. E. Corbould) and Mr. E. R. Tanner. The papers were followed by an interesting discussion. The second meeting was held on October 26, Mr. G. H. D. Chilton, solicitor, in the chair. Two new members were elected. The subject for debate was: "A. promises to marry B. as soon as C. (A.'s father) dies. During C.'s lifetime, A. marries another woman; she dies before C. B., on the death of A.'s wife, sues him for the breach of his promise to marry her, his absolute refusal being implied in his first marriage. A. pleads that before action he was ready and willing to marry B., and that he still is. Can she recover damages? (Frost v. Knight, 26 L. T. 77; Donoghue v. Marshall, 32 L. T. 310; Dennis v. McKenzie, 24 L. f. 363)"-which was opened in the affirmative by Mr. F. J. Harris; the negative was taken up by Mr. A. W. Taylor, and the debate was carried on by Messrs. J. L. V. S. Williams (hon sec.), W. R. Parry, F. Sturge, and E. J. Pillers. The chairman summed up, and the question being put to the vote, was decided in the affirmative by seven to three. The third meeting was held on November 9, Mr. E. M. Harwood, solicitor, in the chair. The resignation of one member was tendered and accepted, and two new members were elected. An excellent paper on the unanimity of juries was read by Mr. E. R. Tanner, and was followed by a discussion, in which the chairman, Messrs. H. Holmes Gore, W. G. Veale, B. Hawkins, A. W. Francis, and J. L. V. S. Williams (hon sec.), took part. Votes of thanks to the reader of the paper, and the chairman terminated the proceedings.

An Order in Council was published in the London Gazette on the 3rd inst. directing, in accordance with a treaty recently concluded and ratified between England and the Republic of Guatemala for the mutual extradition of fugitive criminals, that the Extradition Acts, 1870 and 1873, shall apply to Guatemala after the 13th of December next. It is further ordered that the operation of the Acts shall be suspended within the Dominion of Canada, so far as relates to Guatemala and the treaty referred to, so long as the provisions of the Canadian Extradition Acts of 1877 and 1882 continue in force.

OBITUARY.

Mr. JOHN BALGUY, Metropolitan Police Magistrate, died at Huyton, Lancashire, on the 6th inst. Mr. Balguy was the eldest son of Mr. John Balguy, G.C., who was for many years a commissioner in bankruptcy, and was born in 1821. He was educated at Eton and at Merton College, Oxford, and he was called to the bar at the Middle Temple in Easter Term, 1848. He formerly practised on the Midland Circuit. He was for several years stipendiary magistrate for the Potteries District, and in 1874 he was appointed magistrate at the Greenwich and Woolwich PoliceCourts. Mr. Balguy had presided over several maritime inquiries as Commissioner of Wrecks, and he had obtained a high reputation as a sound criminal lawyer and an efficient magistrate. He was a magistrate for Kent, Staffordshire, and Derbyshire. Mr. Balguy was married in 1858 to the daughter of Mr. James William Ogle, of Beckenham.

Mr. GEORGE MANLEY WETHERFIELD, solicitor, of 2, Gresham-buildings, died at his residence, Highbury. grove, on the 1st inst. Mr. Wetherfield was born in 1820. He was admitted a solicitor in 1847, and he had practised for nearly forty years in the City of London. He was in partnership with his son, Mr. Frederick George Manley Wetherfield, who was admitted a solicitor in 1881. He was a commissioner to administer oaths in the Supreme Court of Judicature and in the Stannaries Courts, and a perpetual commissioner for the county of Middlesex and the cities of London and Westminster. Mr. Wetherfield had an extensive practice in the City of London Court.

The Right Hon. ACTON SMEE AYRTON, barrister, who died at Bournemouth on the 1st inst., at the age of seventy, was the third son of Mr. Frederick Ayrton, of Bombay, and was born in 1816. He was formerly in practice as a solicitor at Bombay, and he was called to the bar at Grays-inn in Easter Term, 1853. In 1852 he unsuccessfully contested the Tower Hamlets in the Radical interest, but he was returned for that constituency in 1857, and again in 1859, 1865, and 1868. He became a frequent speaker in the House of Commons, especially as an advocate of economy, and in December, 1868, on the formation of Mr. Gladstone's First Government, he was appointed Financial Secretary to the Treasury. About a year later he succeeded Mr. Layard in the office of First Commissioner of Public Works and Buildings, and was sworn in as a member of the Privy Council. As First Commissioner he was very unpopular, owing to his zeal for economy and his somewhat aggressive manner in Parliament. In 1873 he was removed to the office of Judge Advocate General, and in March, 1874, he retired with his party, having in the previous month failed to secure re-election for the Tower Hamlets. At the General Election of last year Mr. Ayrton unsuccessfully contested the Mile End Division of the Tower Hamlets.

APPOINTMENTS.

Mr. ROBERT BERRY, LL.D., barrister and advocate, has been appointed Sheriff of Lanarkshire in succession to the late Mr. Francis William Clark. Mr. Berry is the second son of Mr. William Berry, of Tayfield, Fifeshire, and was born in 1825. He was formerly a Fellow of Trinity College, Cambridge, where he graduated as a wrangler and also in the first class of the classical tripos in 1848, and he is an honorary LL.D. of the University of Edinburgh. He was admitted a member of the Faculty of Advocates in Scotland in 1851, and he was called to the bar at the Inner Teaple in Trinity Term, 1853. Mr. Berry was secretary to the Scotch Universities Commission, and he has been professor of the Law of Scotland in the University of Glasgow since 1867.

Sir RICHARD NICHOLAS HOWARD, solicitor, of Weymouth and Portland, has been elected an Alder man for the Borough of Weymouth. Sir R. Howard was admitted a solicitor in 1855. He has been several times mayor of Weymouth, and a few months ago, during his last mayoralty, he received the honour of knighthood. Sir R. Howard is coroner for the island of Portland.

Mr. JOHN WHITWORTH, Solicitor, of Ashton-under-Lyne, has been appointed a Commissioner to administer Oaths in the Supreme Court of Judicature.

Mr. RICHARD TERTIUS WALTER, solicitor, of Ilminster, Somerset, has been appointed a Commissioner to administer Oaths in the Supreme Court of Judicature.

Mr. HENRY J. MILLS, of Norwich, has been appointed a Commissioner to administer Oaths. Mr. Mills was admitted in 1880, and is deputy-coroner for the city of Norwich.

It is understood that the hearing of House of Lord appeals would not be continued after Friday, when the judicial members of the House of Lords will rise for the Christmas vacation. The hearing of these appeals, however, will, it is expected, be resumed about the middle of January
