Upon the whole, we commend this interpretation to our correspondent.-ED. S. J.] VOTES AT TOWN COUNCIL MEETINGS. [To the Editor of the Solicitors' Journal.] Sir,-Enclosed is a query on municipal law which I shall feel obliged by your inserting in your columns. I am aware of some opinions on the point, notably of Mr. Mellish, Q.C., in 1866, and the opinion of Mr. Gaches in his "Town Councillors' and Burgesses' Manual,” page 112; also that in Schedule II. of the Municipal Corporations Act, 1882, paragraph 10, the wording of the rule is slightly altered. W. September 26. QUERY.-At a town council meeting, where there were thirteen members present besides the chairman, on a question being put six voted for and four against, and three besides the chairman did not vote, though they remained in the room. This vote has since been questioned by a member of the council, who contends that, according to section 69 of the Municipal Act (Will. 4), it is not good, as it was not a majority of the members present who voted for it. What is the generally received opinion as to the law on this point? CASES OF THE WEEK. BEFORE THE VACATION JUDGE. DEFAULTING TRUSTEE-ATTACHMENT-PERSON PROSECUTING ORDERCONSOLIDATED ORDERS 23, R. 10, AND 29, R. 3.-In the case of Remington v, Remington, before Day, J., on the 20th inst., sitting as Vacation Judge, a motion was made on behalf of a person having liberty to attend the proceedings in the action that a writ of attachment might be ordered to issue against a defaulting trustee for not paying into court certain sums ordered to be paid in. Counsel in opposition to the motion took the preliminary objection that the applicant, being only a person having liberty to attend the proceedings, was not the person prosecuting the order within the meaning of Consolidated Order 29, r. 3. DAY, J., allowed the objection, and said that "the person prosecuting the decree or order," meant the person having the conduct of the decree or order.-SOLICITORS, J. B. & H. Scott; Symes & Son. married to a daughter of the Right Rev. Dr. Ryder, Bishop of Lichfield, but he had been for several years a widower. His only son predeceased him, and the baronetcy passes to his grandson. MR. RICHARD ANNESLEY BILLING, Q.C. Mr. Richard Annesley Billing, Q.C., died at Melbourne about six weeks ago. Mr. Billing was born in 1814. He was called to the bar in Ireland in 1839, and he practised for several years at Dublin; but he afterwards went to Australia for the benefit of his health, and he was admitted to the bar at Melbourne in 1856. He obtained a good practice in the colony, and he was for several years lecturer in law at the University of Melbourne, where his classes were always largely attended. He was created a Queen's Counsel in 1878, and so recently as April last he had been appointed county court judge for the Western Division of the colony. MR. GEORGE LOCKETT ROBINSON. Mr. George Lockett Robinson, solicitor (of the firm of G. L. & C. F. Robinson), of Burslem and Longton, died on the 4th inst. Mr. Robinson was admitted a solicitor in 1827, and he had practised for many years in the Potteries district, where he had a large and important business. For several years Mr. Charles Frederick Robinson had been associated in practice with him. Mr. Robinson was buried at Edensor on the 8th inst. MR. JOHNSON ATKINSON BUSFEILD. Mr. Johnson Atkinson Busfeild, solicitor, formerly of Bradford, died very suddenly at his residence at Morton, near Bingley, on the 19th inst., in his sixty-ninth year. Mr. Busfeld was the fourth son of Mr. Charles Basfeild, of Bradford, and was born in 1814. He was admitted a solicitor about the year 1836, and for several years carried on an extensive and important business at Bradford, but he had for some time ceased to practise. Mr. Busfeild had been for many years treasurer of the Huddersfield, Bradford, and Keighley County Courts (Circuit No. 11), and after his retirement from practice he was placed in the commission of the peace for the West Riding of Yorkshire. He was very active in his duties as a magistrate for the Keighley Division, in which capacity his professional training and experience proved extremely valuable. Mr. Busfeild was buried at Bingley on the 23rd inst. MR. JAMES POWELL. Mr. James Powell, solicitor (of the firm of Powell & Sargent), of Pockling. 15th inst. Mr. Powell was born in 1831. He was admitted a solicitor in ton and Market Weighton, died at his residence at the former place on the 1856, and he had for many years practised at Pocklington, having also a branch office at Market Weighton. He had a very extensive private practice, and had long held the office of registrar of the Pocklington County Court (Circuit No. 16). He had been for some time associated in partnership with Mr. John Thomas Sargent, who is deputy county court registrar and deputy steward of the Manor of Millington. Mr. Powell was universally esteemed, and his premature death has caused a general feeling of regret throughout the neighbourhood. OBITUARY. SIR GEORGE GREY. Sir In The Right Hon. Sir George Grey, baronet, G.C.B., died at his residence, Falloden, Northumberland, on the 9th inst., in his eighty-fourth year. George Grey was the son of Sir George Grey, Bart., and first cousin of the present Earl Grey. He was born at Gibraltar in 1799, and he succeeded his father in the baronetcy in 1828. He was educated at Oriel College, Oxford, where he graduated first class in classics in 1821. He was called to the bar at Lincoln's-inn in 1826, and he formerly practised on the Northern Circuit. 1832, on the passing of the Reform Bill, he was elected M. P. for the borough of Devonport in the Liberal interest. He soon made his mark as a speaker, and in 1834 he received from his uncle, the second Earl Grey, the appointment of Under-Secretary of State for the Colonies. He filled the same office in the Government of Lord Melbourne, and in 1839 he was appointed Judge Advocate-General and was sworn in as a Privy Councillor, but he retired with his party in 1841. In 1846, on the formation of Lord John Russell's Government, he entered the Cabinet as Secretary of State for the Home Department, and in the following year he was elected M. P. for the Northern Division of the county of Northumberland. He lost his seat at the general election of 1852, but he was shortly afterwards elected M.P. for Morpeth, which borough he represented during the remainder of his parliamentary career. His party went out of office in February, 1852, but in 1854 he became Secretary of State for the Colonies in the Earl of Aberdeen's Cabinet, and a year later, on Lord Palmer. ston becoming Prime Minister, he resumed the office of Home Secretary and held it till February, 1858. On Lord Palmerston's return to office in June, 1859, Sir G. Grey became Chancellor of the Duchy of Lancaster, but in 1861 he became Home Secretary for the third time, and he finally retired from office in 1866. Sir G. Grey will be chiefly remembered from his career at the Home Office, where he was eminent as an administrator rather than as a legislator. He was in office at several periods of great responsibility. In 1848 he had to deal both with an Irish rebellion and with the Chartist riots in London, and he concerted, with the late Duke of Wellington, the measures taken for the preservation of the peace of the metropolis on the 10th of April in that year. In 1866, at the end of his official career, he had to deal with a formidable outbreak of cattle plague. In 1874 he finally retired from parliamentary life, and on that occasion he declined the offer of a peerage. Sir G. Grey was created a Civil Knight Grand Cross of the Order of the Bath in 1849. The party will leave the Paragon Railway Station by a special saloon train at 10 a.m., and, travelling via Beverley, Driffield, and Malton, will arrive at Castle Howard Station at 12 a.m. Thence they will be driven in carriages to the grounds of Castle Howard, distant about three miles; and, after inspecting the mansion, with its magnificent collection of paintings, and the park, the journey will be resumed to York, which will be reached about 3 p.m. At 3 p.m. a substantial lunch will be provided by the Hull Law Society, in the large dining room of the New Station Hotel, at York. After luncheon, the cathedral and other interesting sites of York can be visited, and the return train will leave at 5.25 p.m., and, travelling via Selby, reach Hull at 6.40 p.m. Visitors going north or south, not desiring to return to Hull, will find York a most convenient point for departure. Ladies' tickets, covering the above journey and luncheon, may be obtained by any member on payment of 103. for each ticket. Intimation should be given to the hon. secretary as early as possible. The railway and luncheon tickets will be issued on application to the clerks in attendance at the Royal Institution from 10 a.m. to 3 p.m., on Tuesday, the 17th of October. 10.30 a.m.-Steam Yacht Excursion down the River. The splendid steam yacht Sea Horse, of 340 tons, kindly placed at the disposal of the society by the owner, Walter S. Bailey, Esq., J.P., will leave the Albert Dock Promenade at 10.30 a.m., and convey a party down the River Humber to Spurn, returning so as to reach Hull again about 4 p.m. If the weather should be fine this will be found a very enjoyable cruise. The number of persons must necessarily be limited to fifty, and names will be received until this number is completed. Luncheon will be provided on board. The reading room of the Hull Subscription Library, in the Royal Institution. Albion-street, and the news room of the Church Institute (nearly opposite the Royal Institution) will be available for the use of visitors on production of their cards of membership. It is hoped that the Hull Club, in Lowgate, will be similarly open to visitors. Arrangements will be made for inspecting the New Alexandra Dock Works, in course of construction; Earle's Shipbuilding Works, the Trinity House, and H.M.S. Repulse, &c. N. B.-There will be an inquiry office and writing room at the Royal Institution during the meeting, where letters can be received and posted, and telegrams sent direct. Hotel Accommodation. The hotels are shown on the accompanying plan. As some of these are already filled, the hon. secretary will be glad to arrange accommodation if members will be kind enough to make early application. One of the vacation meetings of this society was held at Clements'-inn Hall, on Wednesday, September 20, when the chair was taken by Mr. Charles Parsons. The subject for debate was, "That the theory of evolution is not inconsistent with the Christian faith," which was opened by Mr. Bull in the negative. He was supported in this view by Messrs. Sutcliffe and Baker and pposed by Messrs. Ridley, Shirley, and Templer. The opener replied, and the chairman summed up, and upon the motion being put to the meeting it was lost by a majority of five. Sir HENRY JAMES BURFORD HANCOCK, Chief Justice of the Leeward Islands who has been appointed Chief Justice of Gibraltar, in succession to the late Mr. Hugh Reilly Semper, is the son of Mr. Henry Hancock, F.R.C.S. He was educated at Eton and was formerly an officer in the 45th Foot. He was called to the bar at the Inner Temple in Hilary Term, 1866, and practised for several years on the Home Circuit and at the Sussex and Brighton Sessions. He was a judge of the District Court in Jamaica from 1876 till 1878, when he was appointed Attorney-General of the Leeward Islands, and Chancellor of the diocese of Antigua. He has been Chief Justice of the Leeward Islands since 1880, and received the honour of knighthood a few months ago. Mr. A. At the half yearly meeting of the Solicitors' Benevolent Association, to be held at Hull on the 18th of October, notice of motion has been given by Mr. William Bariah Brook, of London, that rule 17 be amended, and, as amended, shall be as follows:-XVII. At the autumn general meeting there shall be appointed three auditors, two of whom shall be members, not directors, and one a public accountant, and not a member, to audit the accounts for the ensuing year, the audit of two of whom (one being the public accountant) shall be sufficient." On Tuesday, at the Mold adjourned Licensing Sessions, the question of the power of the magistrates as to the renewal of outdoor licenses was brought prominently forward. In consequence of the passing of the new Act, and the justices at first being doubtful of their powers under it, some half-dozen of the licenses had been held over where there had been several cases of drunkenness. Mr. Charton, solicitor, contended that the magistrates had no power to reconsider the mere question whether the houses were or were not required in the district. Mr. John Scott Banker, chairman of the Court of Quarter Sessions, who presided, said he was of the contrary opinion, and the bench, while renewing the licenses in question, informed the publicans present that if convictions for drunkenness were numerous in their neighbourhoods during the year the magistrates would take into consideration the propriety of entirely withholding their licenses. Replying to the toast of his health at the banquet given to him at Exeter on Thursday week the Lord Chancellor said :-"My office, as you know, is honorary and transitory, and it is partly political; but perhaps it may seem to some to be an anomaly that we should still retain in this country an office which is judicial on the one side and political on the other. To those who might think so I would observe, first, that the objection which would be insuperable to such a union, if that officer had duties connected with the administration of criminal justice, does not apply, at all events, in that way when he has no such duties. But I would also say that between the executive and the independent judicature there are many relations. There is much necessity for mutual understanding and constant communication, and I think it very doubtful whether, if you entirely exclude from the office of the Ministry of State every one who has judicial functions, you would not find the harmony and easy action of those relations considerably impeded. One who is a judge associated with judges, and understands the judicial system, has a part in its maintenance, its authority, and its independence; and as the Executive Government must be assisted by legal counsel for most necessary purposes, I doubt greatly whether it is not a considerable advantage, from a judicial point of view, in having a minister of justice also conversant with the duties of the bench."
