Thursday, the 10th day of August, 1882. Whereas by the order dated the 30th day of June, 1882, making provision for the hearing and determining during the absence on circuit of the Honourable Sir Edward Fry, one of the justices of the High Court of Justice, the causes and matters then pending before the said judge, it was ordered that all such causes and matters should be for all purposes transferred until further order to the Honourable Sir Edward Ebenezer Kay, one of the justices of the High Court. And whereas it has been represented to me that as the circuit has now terminated, it is expedient that the re-transfer hereinafter directed should be made, I, the Right Honourable Roundell Baron Selborne, Lord High Chancellor of Great Britain, do therefore order that the causes and matters by the said order dated the 30th day of June, 1882, transferred from the said Mr. Justice Fry to the said Mr. Justice Kay, be re-transferred from the said Mr. Justice Kay to the said Mr. Justice Fry, and be marked in the and set up in the several offices of the Chancery Division of the High Court cause books accordingly. And this order is to be drawn up by the registrar of Justice. SELBORNE, C.

It is stated that Lord Coleridge has accepted an invitation from the New York bar to visit their city next year.

At the trial of Walsh on Saturday an application was made for the defence that a copy of the indictment might be supplied to the prisoner. Mr. Justice Stephen said he was unable to grant the application. The law of this country was that the accused in cases of felony was not entitled to a copy of the indictment. He had a right to it in cases of treason, but not in felony. He had no power to order it, but at the same time it was in the discretion of the prosecution, The defence might apply to them, and no doubt they would give it them.

CURRENT TOPICS.

LONDON, AUGUST 19, 1882.

THE PROFESSION will do well to take note that a large number of actions set down in the Chancery Cause-books will most probably be transferred to the Queen's Bench Division before the commencement of the next sittings. Should such a transfer take place, notice will, no doubt, be given at the earliest possible date, but it will be well to remember the possibility of this transfer before briefs are delivered.

THE POSITION of the two junior judges of the High Court is, at the present time of the year, by no means an enviable one, since it generally involves the business, not only of the Long Vacation, but also of the Northern Summer Circuit, where the business is always longer than elsewhere. Mr. Justice NORTH has left Liverpool to undertake the vacation business in London, leaving the whole of the business of the circuit to be concluded by Mr. Justice DAY, who will in turn be called upon to sit as Vacation Judge during the latter half of the vacation.

MR. JUSTICE NORTH had before him on Wednesday last a heavy paper, consisting of upwards of eighty petitions and motions. He sat at half-past ten to hear a batch of summonses, and, continuing on until seven o'clock, disposed of the greater portion of this unprecedently heavy paper, but many applications must have remained unheard on Wednesday evening if the application for a sequestration against the Channel Company had given rise to any protracted argument.

THE EXCITING INCIDENT of a sentence of fine and imprisonment inflicted by Mr. Justice Lawson on the High Sheriff and ex-Lord Mayor of the City of Dublin for contempt of court, does not seem likely to give rise to any legal difficulty. There can be no doubt that the articles in the Freeman's Journal, as to the alleged packing of the jury, and the misconduct of the jurors at the recent trial, fell strictly within the definition of contempt of court, as directly tending to bring the administration of justice into contempt, while the fact that the person responsible for those articles filled the office of high sheriff could not but aggravate the gravity of the offence. Collisions between judges and sheriffs are fortunately of rare occurrence, it being just twenty-two years since the late Lord Chief Justice of England fined the High Sheriff of Surrey £500 for publishing a placard, in which he had charged the other judge of assize (the present Lord BLACKBURN) with illegal conduct in excluding the public from the Assize Court at Guildford.

SIR JOHN SMALE, who died on Sunday last, at the age of seventy-seven, within twelve months from his resignation of the post of Chief Justice of Hong Kong, was one of the old generation of Law Reporters, a body which is fast dying out. The only representatives of the original" authorized" reporters now on the bench are Lord BLACKBURN, Mr. Justice KAY, and Mr. Justice CAVE, although in former times such law reporting has frequently proved to be a stepping-stone to the bench, as illustrated by such names as BLACKSTONE, CAMPBELL, BOSANQUET,

TAUNTON, CRESSWELL, ALDERSON, SHADWELL, JERVIS, and CROMPTON. Sir J. SMALE is also one of the many instances of high position being obtained by a lawyer whose professional career was commenced in the other branch of the profession. It may be remembered that Lords Hardwick, KenYON, and TRURO were originally solicitors, and among the present judges Justices FIELD and MANISTY have also practised in the same capacity. Mr. Justice HAWKINS served his term as an articled clerk, as did also Sir JOHN MELLOR and the late Sir JOHN HOLKER and Sir JOHN KARSLAKE.

THE ANNUAL RETURN of the particulars of receipts and expenditure of the High Court of Justice and Court of Appeal (issued pursuant to the Judicature Act, 1875), and of the Court of Bankruptcy and of the Land Registry, has only recently been issued. The return is for the year ending the 31st of March, 1882. In the Chancery Division the principal receipts consist of the usual fictitious item of "Dividends and interest which would have arisen from the stock transferred to the National Debt Commissioners under the provisions of the Courts of Justice (Salaries and Funds) Act, 1869, if such stock had not been cancelled," and of £11,248 for brokerage, £14,458 for fees of taxation, £10,435 for lunacy percentages, and £66,305 for stamps in lieu of fees. The total of these receipts is £207,175, and the total decrease of receipts on the year is £15,788. The payments include £60,921 for salaries of judges, £14,482 retiring annuities of judges, £157,925 for salaries of officers, &c., £4,666 for scrivenery and printing, and £31,754 for compensations, &c., to officers. The total expenditure of the Chancery Division is £290,305, and the net increase of expenditure in this division over that of the previous year is £2,682. Queen's Bench Division the total receipts were £119,611, and the expenditure £201,043. In this division there is an increase of £3,196 in receipts, and a decrease of £8,721 in expenditure. In Probate and Divorce business the total receipts amount to £136,259, and the expenditure to £166,057. The Admiralty accounts given separately, and show receipts amounting to £7,478, and expenditure to £17,968. The district registrars received £25,235, and expended £20,922. For all divisions of the High Court the receipts amounted to a total of £495,759 17s. 10d., and the expenditure to £696,297 5s., showing a net cost to the country for this part of the administration of civil justice of upwards of £200,000. The receipts of the Court of Bankruptcy were £112,718, and the expenditure was £107,521. A heavy balance on the wrong side appears in the return as to the Land Registry, where the fees received amounted to £840 3s. 10d., and the expenditure to £6,050 12s. 11d.

THE LONG-EXPECTED General Order under the Solicitors Remuneration Act, 1881, has now been published, and is given at length in another column. It is to take effect from and after the 31st of December next, and it is not to apply to transactions affecting real property where the title has been registered under the 25 & 26 Vict. c. 53, 25 & 26 Vict. c. 67, or 38 & 39 Vict. c. 87. Part 1 of schedule 1 relates to sales, purchases, and mortgages, and part 2 to leases, or agreements for leases, at rack-rent (other than mining or building leases), various rules being specially applicable to each scale. Schedule 2 relates to the drawing aud perusing of deeds, wills, and to other business not provided for by schedule 1, and to business which is thereby provided for but which is not, in fact, completed. Other important provisions are contained in the order. Thus all drafts and copies made in the course of business, the remuneration for them being provided for
