Mr. Willson contacted our office by phone regarding a claim
for compensation. He had sustained a knee injury on the
job at the Norfolk Naval Shipyard on March 8, 1976. He
He was hospitalized at the General Hospital of Virginia
Beach for surgery on the knee in April, 1976. Bill has not
been paid and he is being threatened with a lawsuit for non-
payment.

I talked with Mrs. Marshall at the hospital and she said this was true. She would, however, put the bill back in the cycle, which would give him another month.

Our office wrote letter to OWCP.

Received an interim reply from OWCP dated February 22.

Sent another letter from our office to OWCP.

Received reply to our letter of February 16; OWCP had no
record of the hospital bill.

Another letter sent from our office to OWCP after talking with Mrs. Matha Williams at the hospital. Mr. Willson's claim has been turned over to the legal department and a warrant will be issued soon for the $965.50 due.

Called Mr. Hickey, OWCP, and asked for information and help on this claim.

Mrs. Duckett, OWCP, called but had no record of an out-
standing bill in Mr. Willson's file.

NO FURTHER INFORMATION FROM OWCP SINCE. GAVE SOME INFO ON THIS TO OUR WASHINGTON OFFICE FOR POSSIBLE USE IN HEARINGS BEFORE SUB-COMMITTEE.

Mr. Emmett H. Allen called re compensation claim filed at NAS Oceana for hearing loss. Loss of hearing caused him to loose his job as Fire Captain. Is on sick leave now, but will soon run out. Said he would come to office.

Came into office. Filed claim 23 June, 1975. Claim number:
A25-21354. CA-1 and 2 sent in at that time. He is a fire-
fighter not allowed to work because of his loss of hearing.
Asked for our help to expedite claim.

Called District 25. Talked to Mrs. Darden. She said she would locate claim and call me back. Called back same day. Had located claim and would start to work on it.

Mrs. A. called. He received a notice that his claim had been approved for a scheduled award. 64 weeks compensation. 328 hearing loss--$650.40 monthNo word yet in our office on award. Mr. A. concerned over scheduled award. The 64 weeks compensation terminate 3 Oct., 1976 at which time he will still need 2 more years in order to retire on optional retirement. Is, of course, eligible to file for disability retirement., Does not want to do this at this time as he feels that his hearing loss award should be for loss of wages instead of a scheduled award. Wants us to pursue this. Must have 20 years as a firefighter to retire on optional.

Called Mr. Hendler in national OWCP office. He told me that
he must submit another claim for wage loss, but this claim could
not be processed until scheduled award terminates. Cannot file
for both claims if both claims are for same injury.

CASE CLOSED AT THIS POINT.

Mr. A. called. Has received approval on disability retirement.
Says NAS Oceana has sent in papers on wage loss claim.

Called Oceana. Mr. Taylor claims that everything requested by OWCP has been sent. Donald Frederick claims that they have requested additional information, but Mr. Taylor has not received such a request. Mr. Taylor will write to OWCP.

From August, 1976 until the last letter, dated 24 March, 1977, Oceana, Mr. Allen, and our office have been trying to understand just exactly WHAT information OWCP wants. Please refer to the correspondece.

Mr. A. called. Got a letter from OWCP asking for a complete

physical examination.

Dr. Burke is the physician referred to.

Called Mr. A. He has had the examination and is waiting for
Dr. to send information to OWCP.

MY COMMENTS

In no way am I qualified to judge on compensation claims. I,
however, feel that this man has lost his job because of a hear-
ing loss which should give him some consideration in OWCP for
compensation for wage loss. This decision was never made. In-
stead, a scheduled award was given to him "to tide him over"
as was told me by one employee in District 25. It took from
23 June, 1975 until December, 1975 until he received any compen-
sation at all. A decision on compensation for wage loss still
has not been made. although scheduled award ran out 3 Oct., 1976.

Claimant was originally injured on the job July 7, 1975. Out of work
until August 11, 1976. Claims recurrence of injury on August 13, 1976.
Came to our office September 23, 1976. Had been having difficulty
with forms for compensation. Civilian Personnel at Naval Station,
Norfolk, trying to clear up some discrepancies on forms before for-
warding to OWCP.

January 28 Talked with Ms. Brown, OWCP, could not find file.

February 1 - Mr. Burroughs of OWCP says updated CA8 needed.
April 8 Mrs. Derricott called our office, said Mrs. Newkirk told
her file has been misplaced.

April 21 - Contacted Mr. Worth in Mr.. Rice's office trying to locate the file. Mr. Worth said Mr. Hickey would call me back on this. The file is supposed to be in District 25.

April 27 Mr. Hickey called, said the file has not been located.
They are still searching and will call me back when it is found.
Received no further word on this but Mrs. Derricott called our office

on

She said the file has been lost as per letter to her from
Mr. John Petty, OWCP, and needs to be reconstructed. Copied all
documents in our files and sent them on to OWCP.

Our office sent letters to OWCP on October 8, 1976, November 24,
1976, March 18, 1977 and May 26, 1977. THE ONLY THING WE HAVE
RECEIVED FROM OWCP IS TWO ACKNOWLEDGMENTS OF OUR LETTERS AND AB-
SOLUTELY NO INFORMATION ON THIS CLAIM.

Marshall. No response from Secretary Marshall.

Received letter from OWCP regarding Mr. Butts' entitlements and amounts paid.

Mrs. Butts, in the absence of her husband, re-
ceived a telephone call from Mr. John Petty,
OWCP, advising that Mr. Butts would receive pay-
ment through 15 Mar within seven days. Mr.
Butts called Mr. Petty back and asked why such
a long delay. Mr. Butts advised that he felt
Mr. Petty's comments regarding his request for
assistance from his Congressman were totally
uncalled for. It is his right to contact his
Congressman as he sees fit.

Mr. Butts will send letter reporting on this
conversation.

Letter sent to Secretary Marshall forwarding a
copy of Mr. Butts' letter referenced above.
To date no response whatsoever from Secretary
Marshall.
