(6) The exercise by any child or young person in any A.D. 1924. recognised efficient school, during a portion of the school hours, of any manual labour for the purpose of instructing him in any art or handicraft shall not be deemed to be an 5 exercise of manual labour for the purpose of gain within the meaning of this Act. (7) Where the Secretary of State by special order so directs as respects all or any purposes of this Act, different branches or departments of work carried on in 10 the same factory shall be deemed to be different factories. 15 20 25 30 35 40 137.-(1) In this Act, unless the context otherwise General requires, the following expressions have the meanings interpretahereby assigned to them respectively, that is to say : 66 66 66 Appointed doctor" means in relation to any pro- tion. Machinery" includes any driving strap or band: 66 99 Owner means the person for the time being 5 receiving the rackrent of the premises in connection with which the word is used, whether on his own account or as agent or trustee for any other person, or who would so receive the same if the premises were let at a rackrent : 10 "Parent" means a parent or guardian of, or person having the legal custody of, or the control over, and includes any person having direct benefit from the wages of, a child or young person: 66 Prescribed " means prescribed for the time being by the Secretary of State : 15 "Prime mover" means every engine motor or other appliance which provides mechanical energy derived from steam, water, wind, electricity, combustion or 20 other source: Process" includes the use of any locomotive : "Railway" means a railway within the meaning of the Railway Employment (Prevention of Accidents) Act, 1900: 66 "Ship," vessel," and "harbour" have the same "Steam receiver " means any vessel or apparatus used 66 25 30 35 40 5 "Woman" means a woman who has attained the A.D. 1924. age of eighteen : "Young person means a person who has attained the age of fourteen but has not attained the age (2) A woman, young person, or child who works in a factory, whether for wages or not, either in a process or in cleaning any part of the factory used for any process, or in cleaning or oiling any part of the machinery, 10 or in any other kind of work whatsoever incidental to or connected with the process, or connected with the article made or otherwise the subject of the process therein, shall, save as is otherwise provided by this Act, be deemed to be employed therein within the meaning 15 of this Act. (3) For the purposes of this Act an apprentice shall be deemed to be a person employed. (4) Where any operation or thing is required under this Act to be performed or done at specified intervals, 20 each period during which the operation or thing is required to be performed or done shall be deemed to commence as from the date on which the operation or thing was last performed or done. PART XIV. 25 30 SUPPLEMENTARY. 138.-(1) This Act applies to factories belonging Application to the Crown and to building operations and engineering to factories belonging to works undertaken by or on behalf of the Crown; but the Crown in case of any public emergency the Secretary of State and public may, by order, to the extent and during the period authorities. named by him, exempt from this Act any factory belonging to the Crown or any building operation or engineering work undertaken by or on behalf of the Crown, or any factory in respect of work which is being 35 done on behalf of the Crown under a contract specified in the order. (2) A factory belonging to or in the occupation of the Crown or any municipal or other public authority, and a building operation or engineering work undertaken 40 by or on behalf of the Crown or any such authority, shall not be excluded from the operation of this Act A.D. 1924. by reason only that it is not carried on or undertaken by way of trade or business or for the purpose of gain. Inspection of certain Government premises. Expenses of Application (3) The powers conferred by this Act on a district council shall, in the case of a factory belonging to or in the occupation of the Crown, be exercised by an 5 inspector under this Act; and any notice required by this Act to be sent to a district council shall in any such case be sent to the inspector for the district. 139. Where in any premises which are subject to inspection by or under the authority of any Government 10 department any manual labour is exercised, otherwise than for the purposes of instruction, in or incidental to the making, altering, repairing, ornamenting, finishing, washing, cleaning, or adapting for sale, of any article, and the premises do not constitute a factory by reason 15 that the work carried on therein is not carried on by way of trade or for the purposes of gain, or by reason that the persons employed in the work are not working under a contract of service or apprenticeship, the Secretary of State may arrange with the department that the premises 20 shall, as respects the matters dealt with by this Act, be inspected by an inspector appointed under this Act, and where such an arrangement is made, such inspectors shall have, as respects such matters as aforesaid, the like right of entry and inspection as is conferred on 25 inspectors of the department concerned. 140. The expenses of the Secretary of State in carrying this Act into effect shall be defrayed out of moneys provided by Parliament. 141. (4) The expression "inspector of nuisances means sanitary inspector within the meaning of the Public Health (Scotland) Act, 1897; the expression "local education authority under the Education Act, 1921," means the education authority under the Education (Scotland) Act, 1918"; the expression "court of summary jurisdiction and the expression county court" mean the sheriff court, and references to the judge of the county court shall be construed as references to the sheriff; the expression "information " means petition or complaint; the expression "informer " means petitioner, pursuer or complainer; the expression "defendant means defender or respondent; a reference to a coroner's inquest shall be construed as a reference to a public inquiry held under the Fatal Accidents Inquiry (Scotland) Act, 1895, or the Fatal Accidents and Sudden Deaths Inquiry (Scotland) Act, 1906; the expression "attending before a court of record " means attending an inquiry under the last mentioned Acts; the expression "Master of the supreme court" means the auditor of the sheriff court; references to sections one hundred and eighty-two to one hundred and eighty-six of the Public Health Act, 1875, shall be construed as references to sections one hundred and eighty-three to one hundred and eighty-seven of the Public Health (Scotland) Act, 1897; the expression "recognised efficient school" means any public or other school under government inspection; the expression "owner" means the person for the time entitled to receive or would, if the same were let, be entitled to receive the rents of the premises, and includes a trustee, factor, tutor or curator, and in the case of public or municipal property, applies to the persons to whom the management thereof is entrusted; the expression " poor law medical 66 |
