purpose of making transfers for use in the manufacture or decoration of carthenware and china is dangerous or injurious to health. A special meeting of the metropolitan magistrates was held at Bowstreet on Wednesday afternoon to consider what course should be pursued in respect to applicants who wished to claim exemption from vaccination for their children by reason of their conscientious objection in accordance with section 2 of the new Act. As a result of the deliberations, the following statement was issued for publication: "The magistrates decided that they will hear applications under the Vaccination Act, and will not require applicants to be sworn; but if satisfied upon a verbal statement that they have the conscientious objection will give the certificate. All applications must be made at the sitting of the court; and, in conformity with the statutory scale of fees in similar cases, 18. must be paid for such certificate." At Marylebone, on the 27th ult., Mr. Curtis Bennett, in again referring to the new Vaccination Act, said that the remarks he had made with reference to the Act had been made to save the public the trouble of coming to his court to be told that he had no power to do anything. He was unable, on Saturday last, when his attention was first specifically called to the Act then in force for only a few days as to one particular section-the remainder of the Act not coming into force until the first of January next-to find any power which enabled them as metropolitan magistrates for the purposes of this Act to be considered a court of petty session; and, indeed, it was not until the previous evening that he had been able to obtain any information, although he had given much time to discover some authority for their so acting for the public good. In the Summary Jurisdiction Act, 1879, it was expressly provided by sub-section 10 of section 20 that any metropolitan magistrate when sitting at a courthouse should for the purposes of that Act be deemed to be a court of summary jurisdiction sitting "in a petty ɛessional court-house," which was in that Act included in the expression "petty sessional courts." This Act only applied to Acts passed afterwards and incorporated in it. That was not so with the Vaccination Act. He bad looked in vain for any such power in any of the Vaccination Acts. In again endeavouring to find some legislative power which would meet his difficulty he discovered in an Act designated the Interpretation Act—namely, 52 & 53 Vict. c. 63, s. 13, sub-section 12, of which he was bound to say he had no knowledge, and as far as he knew his colleagues were not acquainted with it-that there was a definition of a petty sessional court, which he thought met his difficulty and enabled them as metropolitan magistrates to be considered a court "in petty session," although the words used in the Vaccination Act were "in petty session," and not, as they should have been to have complied with the defining Acts, "in a petty sessional court." He was of opinion that this gave them power to deal with section 2 of the new Vaccination Act. CURRENT TOPICS. .......... 755 ON WEDNESDAY Mr. Justice PHILLIMORE used the Lord Chief Justice's Court for the Vacation Court, with a view to avoiding the crowding and inconvenience to which persons attending the court have hitherto been subjected. The list included 54 cases, but half of these were adjournments from previous weeks. On Tuesday the judge disposed of 46 Queen's Bench summonses at chambers, 30 of which were attended by counsel, besides hearing several ex parte applications. THE METROPOLITAN police magistrates have by their combined wisdom got over the difficulties which were at first thought to be incident to the case of the "conscientious objector" to vaccination, and they have resolved upon a form of certificate which, so soon as it is printed, will be available for all and sundry who choose to make their statement of objection and pay the shilling demanded. The form goes further than is really required by the Act. Under the Act it would be sufficient for the magistrate to certify that he is satisfied that the applicant "conscientiously believes that vaccination would be prejudicial to the health of the child." In addition to this the form sets forth the evidence on which the magistrate's satisfaction is founded. The reference to the objector's conscience is, of course, futile. If he believes in the injurious effect of vaccination at all, he must believe conscientiously, and for the purpose of the magistrate his statement that he believes is enough. Moreover, if he believes that vaccination is injurious generally, he believes this in the case of the particular child. At first magistrates may try to probe the objector's conscience or to reason with him. But the novelty of the procedure will soon wear off, and the objector's statement will be accepted without cavil. Laing (supra), however, there are to be found dicta of Lord ESHER, M.R., in favour of what appears to be the more equitable principle, that items which are common to the claim and counter-claim that is, items which must have been incurred by the defendant had he brought an independent action-ought to be apportioned. These dicta have now been considered by the Court of Appeal in Atlas Metal Co. v. Miller, but they have not been accepted as really infringing the established rule. The person upon whom fall the costs of the claim does not benefit in any way by the fact that a counter-claim has been made. He is primarily responsible for the litigation and he must bear the brunt of it. But when a claim has once been made, the defendant is at liberty to introduce a counter-claim, and the counter-claim then profits by the procedure. "Counter-claims," said LINDLEY, M.R., in his judgment in the present case, although cross-actions for all purposes of procedure and evidence, cost less than actions, and the party who has to pay the costs of the counter-claim gets the benefit of the cheaper procedure." I. BY SECTION 22 of the Settled Land Act, 1882, it is provided that capital money arising under the Act shall be paid either to the trustees of the settlement or into court, at the option of the tenant for life. In Re Fisher and Grazebrook's Contract (ante, p. 731) an attempt was made to use this option for the purpose of getting rid of the necessity of appointing trustees of the settlement. It was contended on behalf of a vendor tenant for life that, if the vendor elected to have the money paid into court, the purchaser would get a good title, although there were no trustees, and although he knew that there were no trustees. But though up to a certain point a purchaser need not concern himself with the existence of trustees, yet the decisions on the subject have not gone as far as this. Trustees ought to be in existence for the purpose of receiving notice of an intended sale or lease by the tenant for life, and also, when any money is payable, for the purpose of receiving the money. With the giving of the notice, however, the intending purchaser or lessee is not directly concerned, and, if he deals in good faith with the tenant for life, his title will not be invalidated by the fact that no notice has been given (Settled Land Act, 1882, s. 45 (3)). Clapp, 1892, 3 Ch. 382), provided he was not aware of the defect (Hughes v. Fanagan, 30 L. R. Ir. 111). .And in the case of a sale it is sufficient if there are trustees at the time when the sale is completed (Hatten v. Russell, 38 Ch. D. 334). But in both Hatten. Russell and Mogridge v. Clapp it was intimated that the existence of trustees at that time is necessary. 'The tenant for life," said KAY, J., in the former case," where there are trustees, has an option. He may then direct the purchaser to pay the money either to the trustees or into court; but I think it is obvious that the meaning of the option is that he may choose between the two, and that that option cannot properly be exercised, and cannot really be exercised at all, if there are no trustees." Upon this view ROMER, J., acted in Re Fisher and Grazebrook's Contract, and held that the purchaser was entitled to insist on the appointment of trustees of the settlement prior to completion by the purchaser. The decision, it is to be observed, went on the ground of the purchaser's knowledge that there were no trustees. If he had paid the money into court under the belief that there were trustees for the purposes of the Settled Land Acts, it appears that he would have got a good title.
